NOTICE OF LIS PENDENS <br />TO WHOM IT MAY CONCERN: 85-- 003320 <br />You are hereby notified that on the Sth day , 1985 <br />William D. Fairbanks and Patty Jo Fairbanks, husbandfandlwife, <br />d /b /a Fairbanks Land Development, Plaintiff, filed their Petition <br />in action in the District Court of Hall County, Nebraska against <br />Roger W. Augustin, Lois Y. Augustin, husband and wife, City <br />National Bank and Trust Company, Hastings, Nebraska, and Margaret <br />L. Augustin, Defendants, the object and prayer of which <br />is to foreclose a certain mortgage on the following described <br />real estate, to -wit: <br />All of Lot Six (6) on Island, and that part of Lot One <br />(1) on Island, more particularly described as commencing <br />at the Northeast corner of Lot Six (6) on Island in <br />said Section Nineteen (19); running thence North along <br />an extension of the East line of said Lot Six (6) to a <br />point where said so- extended East line of said Lot Six <br />(6) intersects the Center line of the County Road <br />right -of -way (which County Road right -of -way runs in a <br />Northeasterly to Southwesterly direction Northerly from <br />the premises herein conveyed); running thence in a <br />Southwesterly direction along and upon the Center line <br />of said County Road right -of -way to a point where said <br />County Road right -of -way Center line intersects the <br />West line of said Lot Six (6), as sut-h West line is <br />extended to the North; running thence South along <br />the so- extended West line of said Lot Six (6) to the <br />Northwest corner of said Lot Six (6); running thence <br />East along and upon the North line of said Lot Six <br />(6) to the point of beginning, and being the Northeast <br />corner of said Lot Six (6), all in Section Nineteen <br />(19), Township Nine (9) North, Range Eleven (11) West <br />of the 6th P.M., Hall County, Nebraska, together with <br />all accretions thereto, <br />given by the Defendant, Roger W. Augustin, on the 14th day of <br />December, 1981, to Plaintiffs, and that said mortgage was duly <br />filed of record in the office of the Register of Deeds of Hall <br />County, Nebraska on the 14th day of December, 1981 and duly <br />recorded at Number 81- 006112 of the Mortgage Records of said <br />county. <br />Plaintiffs claim that there is now due $126,000.00 on said <br />mortgage and note they were given to secure, and they pray for the <br />sale of the real estate above described to satisfy the amount <br />found due on the mortgage and interest and costs. <br />Dated this 10th day of July, 1985 <br />WILLIAM D.
