! <br />E <br />85' 003087 <br />E1 MEMORANDUM AND RATIFICATION OF <br />LEASE AND OPTION TO RENEW <br />HERITAGE VILLAGE OF GRAND ISLAND -SOUTH <br />GRAND ISLAND. NEBRASKA <br />Made as of the r day of bir U d. Y 1985, by and <br />between LAKEVIEW HOMES, INC., a Nebraska corpora on, <br />( "Landlord "), NORTH HILLS ESTATES, INC. a Delaware corporation <br />( "Tenant "), and MED WEST HEALTH CARE MANAGEMENT CORPORATION, a <br />South Dakota corporation ( "Assignee "). <br />Notice is hereby given that Landlord has leased to Tenant <br />the following described property (as now expanded and amended by <br />this agreement) in Hall County, Nebraska, by Lease and Addendum <br />thereto dated December 29, 1977, to -wit: <br />L <br />Lots One (1), Three (3), Four (4), Five (5), <br />Six (6) and Seven (7), Phillips Subdivision, <br />Hall County, Nebraska, and the Westerly Four <br />Hundred Feet (W -4001) of the Northerly Thirty <br />Five Feet (N -35') of the South Half of the <br />Northwest Quarter of the Northeast Quarter <br />(S1 /2NW1 /4NE1 /4) of Section Thirty Three <br />(33), Township Eleven (11) North, Range Nine <br />(9), West of the 6th P.M., in Hall County, <br />Nebraska. <br />Tenant .assigned the above - described property to Assignee, by <br />Agreement of Assignment. <br />The Lease has been amended by Addendum No. 2 thereto, dated <br />as of September 6, 1984, and the legal description is hereby <br />amended and expanded as set forth above. <br />The Lease is for a term of five (5) years, terminating on <br />December 31, 1982, and provides for the termination in the event <br />of the happening of certain continencies and provides for an <br />option to renew the Lease. <br />The Landlord, Tenant and Assignee hereby affirm, acknowl- <br />edge, ratify and approve the Lease and Addendums thereto and the <br />Agreement of Assignment and further acknowledge and agree that <br />the option to renew has been extended and the Lease and the <br />Option to Purchase, at a price of One Million Four Hundred Fifty <br />Thousand and no /100 Dollars ($1,450,000.00), is valid in <br />accordance with its terms, with the purchase price amended as set <br />forth herein. <br />The addresses of the parties are: <br />LANDLORD: Lakeview Homes, Inc. <br />P.O.
