r <br />REAL ESTATE MORTGAGE <br />HAROLD A. GIBSON, JR. and JOY A. GIBSON, husband and wife, herein <br />called the Mortgagors, in consideration of TWO THOUSAND AND <br />NO 1100 DOLLARS ($2,000.00) do hereby mortgage to ROBERT R. WIESE <br />and JOAN A. WIESE, husband and wife, as joint tenants with right <br />of survivorship, herein called the Mortgagees, the following - <br />described real estate in Hall County, and State of Nebraska: <br />Lot Three (3), in Block Eight (8), of Hann's <br />Third Addition to the City of Grand Island, <br />Hall County, Nebraska. <br />The Mortgagors do hereby covenant with the Mortgagees and <br />with Mortgagees' heirs and assigns that Mortgagors are lawfully <br />seized of said premises, that they are free from encumbrance, <br />that Mortgagors have good right and lawful authority to convey <br />the same, and that Mortgagors warrant and will defend the title <br />to said premises against the lawful claims of all persons whomso- <br />ever. <br />This Mortgage is a purchase money mortgage given to secure <br />the payment of the principal sum of Two Thousand and No /100 <br />Dollars ($2,000.00) and interest thereon, according to the terms <br />of a certain Promissory Note of even date, executed by the <br />Mortgagors to the Mortgagees, due the 1st day of July, 1987, the <br />terms and conditions of which note are incorporated herein and <br />made a part hereof by this reference. <br />The Mortgagors agree to pay all taxes and assessments upon <br />said premises and all other taxes, levies and assessments levied <br />upon this Mortgage and the Note which this Mortgage is given to <br />secure before the same become delinquent. In the event the <br />Mortgagors shall fail to pay such taxes before delinquent, the <br />Mortgagees may pay such taxes or other liens and shall have a <br />lien secured hereby for the amount so advanced with interest <br />thereon at the maximum legal. rate. <br />In the event the Mortgagors default in the payment of said <br />indebtedness or any installment thereof, or fail to perform any <br />of the other agreements herein, the Mortgagees at their election <br />may declare the entire debt secured by this Mortgage to be due <br />and collectible at once; and may foreclose this Mortgage for the <br />satisfaction thereof. <br />The Mortgagors further agree that payment hereunder shall be <br />made to Mortgagees as joint tenants and in the event of the death <br />of either of said Mortgagees, all payments due hereunder shall be <br />made to the survivor of them who may execute and deliver a <br />-1- <br />IN <br />L � L <br />_l <br />h <br />L.__ <br />
