t <br />F 85-00269,? <br />REAL ESTATE MORTGAGE <br />DOUGLAS D. O'BRIEN and LINDA K. O'BRIEN, husband and wife, <br />herein called the Mortgagors, in consideration of the sum of <br />TWENTY THOUSAND AND NO 1100 DOLLARS ($20,000.00), do hereby mortgage <br />to ERMA K. O'BRIEN, herein called the Mortgagee, the following - <br />described real estate in Hall County, and State of Nebraska: <br />Lot Twenty -Six (26), Le Heights Fourth <br />Subdivision, a tract of land comprising a <br />part of the East Half of the Northwest <br />Quarter (E 1/2 NW 1/4) of Section Eleven <br />(11), Township Eleven (11) North, Range <br />Ten (10) West of the Sixth (6th) Principal <br />Meridian, Hall County, Nebraska. <br />And the Mortgagors do hereby covenant with the Mortgagee and <br />with Mortgagee's heirs and assigns that Mortgagors are lawfully <br />seized of said premises, that they are free from encumbrance, <br />that Mortgagors have good right and lawful authority to convey <br />the same, and that Mortgagors warrant and will defend the title <br />to said premises against the lawful claims of all persons whom- <br />soever. <br />This Mortgage is given to secure the payment of the principal <br />sum of Twenty Thousand and No /100 Dollars ($20,000.00) and interest <br />thereon, according to the terms of a certain Promissory Note of <br />even date, executed by Douglas D. O'Brien, d /b /a Atcom Business <br />Services, in favor of the Mortgagee, due on demand, the terms and <br />conditions of which Note are incorporated herein and made a part <br />hereof by this reference. <br />The Mortgagors agree to pay all taxes and assessments upon <br />said premises and all other taxes, levies and assessments levied <br />upon this Mortgage and the Note which this Mortgage is given to <br />secure before the same become delinquent. In the event the <br />Mortgagors shall fail to pay such taxes before delinquent, the <br />Mortgagee may pay such taxes or other liens and chall have a lien <br />secured hereby for the amount so advanced with interest thereon <br />at the maximum legal rate. <br />In the event the Mortgagors default in the payment of said <br />indebtedness or any installment thereof, or fail to perform any <br />-1- <br />U <br />L L � <br />--I <br />
