SPECIAL WARRANTY DEED 85- 002676 <br />KNOW ALL MEN BY THESE PRESENTS: THAT we, TERRENCE MICHEAL NOVAK AND <br />JEAN LEE NOVAK, husband and wife, of the county of Gage, State of <br />(" Nebraska, have agreed to give up and surrender the lands hereinafter <br />1 described in lieu of a foreclosure, as security for the amount of <br />money remaining unpaid on said mortgage, do hereby sell and convey <br />unto ADMINISTRATOR OF VETERANS AFFAIRS OF WASHINGTON, D.C., its successors <br />and assigns. for and in consideration of the sum of Twenty Thousand <br />Five Hundred Eighty -four and 86/100 Dollars ($20,584.86), and other <br />valuable consideration, the following described premises, to -wit: <br />Lot One (1), Block Thirty -two (32), in Russel <br />Wheeler's Addition to the City of Grand Island, <br />Hall County, Nebraska. <br />together with all appurtenances thereunto belonging, free and clear of <br />all encumbrances except a first mortgage in favor of Mortgage Plus <br />Incorporated, which was assigned to First Denver Mortgage Company, now <br />known as IntraWest Mortgage Company, Denver, Colorado, in the principal <br />sum of Twenty -one Thousand Five Hundred and No /100 Dollars ($21,500.00), <br />dated March 8, 1979 and filed for record March 8, 1979, in Document <br />No. 79- 001273, of the Mortgage Records of Hall County, Nebraska, and <br />easements and restrictions of record, and do covenant to warrant and <br />defend the said premises against any act of said grantors or any other <br />person claiming through or under it. The grantee hereby releases and <br />discharges any and all liens and claims under and by virtue of the <br />mortgage aforesaid for a deficiency judgment. The _grantors further <br />covenant that this conveyance is and does constitute an absolute <br />conveyance of title to the premises to the grantee herein in effect as <br />well as form, and is not intended as a mortgage, trust conveyance, or <br />as security of any kind and that possession of the premises is delivered <br />concurrently herewith.
