Mortgagor covenants and agrees that this mortgage or deed of trust is additionally <br />subject to all terms and conditions of the construction loan agreement between <br />mortgagor and beneficiary of even date herewith, which is, by this reference, <br />incorporated herein as additional terms and conditions of this mortgage or deed of <br />trust. Mortgagor additionaily covenants and agrees that any default under the provisions <br />of said construction loan agreement shall also he default under this mortgage or deed of <br />trust and that waiver at any time of a breach of any provision hereunder or provision <br />under said construction loan agreement shall not, at any other time, be taken to be a <br />waiver of the terms hereof or of the right to exercise one or more remedies by <br />beneficiary. <br />C. It is further mutually agreed that any extension of the note shall not create a <br />novation, and that the lien of the mortgage or deed of trust as to principal and adjusted <br />interest as accrued shall at all times be on a parity with the lien of the mortgage or deed <br />Of trust as to principal and initial interest rate at date of execution of the note. <br />D. In addition to the amounts secured hereby mortgagor covenants and agrees that any <br />and all amounts advanced by beneficiary pursuant to its note, construction loan <br />agreement, and this mortgage or deed of trust shall be deemed a part of the debt hereby <br />secured and recoverable as such in all respects. <br />R. Mortgagor agrees that, during the term hereof, and not to exceed the real estate as <br />legally described in the mortgage or deed of trust (1) any greater title of mortgagor to <br />the said real Mate or, (2) title to the said real estate hereafter acquired by mortgagor, <br />upon either such event, shall be subject hereto, deemed to he n part of the said real <br />estate and, to the maximum extent permitted by law, shall hav, the same lien rank and <br />Priority as that first occurring under this mortgage or deed of trust. <br />DATED this 29th day of April, 1985. <br />
