EASEMENT AGREEM M 85- 001793 WHEREAS, Lanny W. Berck, single, referred to as First Party, is the owner of the following- described real estate: Lot Feur (4), Block Forty-two (42), Russell Wheeler's Addi- tion to the City of Grand Island, Hall County, Nebraska; and WHEREAS, Donald E. McQuitty, Sr. and Ruth E. McQuitty, husband and wife, re- ferred to as Second Party, are the owners of the following- described real estate: Lot Three (3), Block Forty -two (42), Russell Wheeler's Addi- tion to the City of Grand Island, Hall County, Nebraska; and WHEREAS, a common driveway exists on the boundary line between the two properties as shown on the Plot Plan marked Exhibit "A' and incorporated herein by reference; and WHEREAS, the parties desire to grant to each other the necessary cross easements for the purpose of using aad maintaining the common driveway for access to each party's respective garage at the rear of each lot. NOW, THEREFORE, for valuable consideration, receipt of which is hereby acknow- ledged by each party, the parties agree as follows: 1. First Party hereby grants to Second Party an easement to enter upon First Party's concrete driveway on First Party's premises for the purpose of using the driveway for access to Second Party's automobile garage. 2. Second Party hereby grants to First Party an easement to enter upon Second Party's concrete driveway on Second Party's said premises for the purpose of using the driveway for access to First Party's automobile garage. 3. First Party and Second Party each agree to maintain their respective portions of the concrete driveway in good condition; to not block the driveway or interfere with the other party's use of the driveway; and to cooperate in the removal of snow. THIS EASEMENT AND AGREEMENT shall run with the land and be binding upon the parties hereby, their respective heirs, devisees, personal representatives, and assigns.
