EASEMENT AGREEM M 85- 001793 <br />WHEREAS, Lanny W. Berck, single, referred to as First Party, is the owner of the <br />following- described real estate: <br />Lot Feur (4), Block Forty-two (42), Russell Wheeler's Addi- <br />tion to the City of Grand Island, Hall County, Nebraska; and <br />WHEREAS, Donald E. McQuitty, Sr. and Ruth E. McQuitty, husband and wife, re- <br />ferred to as Second Party, are the owners of the following- described real estate: <br />Lot Three (3), Block Forty -two (42), Russell Wheeler's Addi- <br />tion to the City of Grand Island, Hall County, Nebraska; and <br />WHEREAS, a common driveway exists on the boundary line between the two properties <br />as shown on the Plot Plan marked Exhibit "A' and incorporated herein by reference; and <br />WHEREAS, the parties desire to grant to each other the necessary cross easements <br />for the purpose of using aad maintaining the common driveway for access to each party's <br />respective garage at the rear of each lot. <br />NOW, THEREFORE, for valuable consideration, receipt of which is hereby acknow- <br />ledged by each party, the parties agree as follows: <br />1. First Party hereby grants to Second Party an easement to enter upon First <br />Party's concrete driveway on First Party's premises for the purpose of using the <br />driveway for access to Second Party's automobile garage. <br />2. Second Party hereby grants to First Party an easement to enter upon Second <br />Party's concrete driveway on Second Party's said premises for the purpose of using the <br />driveway for access to First Party's automobile garage. <br />3. First Party and Second Party each agree to maintain their respective portions <br />of the concrete driveway in good condition; to not block the driveway or interfere with <br />the other party's use of the driveway; and to cooperate in the removal of snow. <br />THIS EASEMENT AND AGREEMENT shall run with the land and be binding upon the <br />parties hereby, their respective heirs, devisees, personal representatives, and <br />assigns. <br />WITNESS our signatures this vU day of 1985. <br />DANNY W.
