requirement that Grantor make payments to the Escrow Fund as provided <br />I below and payments are required to be made into the Escrow Fund by <br />Grantor, to the extent such payments are actually made, American <br />shall pay those taxes and charges to the appropriate authority or <br />party on behalf of Grantor. If the amount of the Escrow Fund shall <br />exceed the amounts actually due, American shall, in its sole and <br />absolute discretion to the extent permitted by law, return any excess <br />to Grantor, or credit such excess against future payments to be made <br />to the Escrow Fund, or apply the excess to the reduction of the <br />Obligation. In allocating such excess, American may deal with the <br />person shown on the records of American to be the owner of the <br />Property. <br />(b) American may, in its sole discretion, for any <br />period of time and on any terms and conditions, waive in writing the <br />requirement that Grantor make the monthly payments to the Escrow Fund <br />and allow Grantor to pay directly to the appropriate autnorities or <br />institutions such Impositions. In the event American allows Grantor <br />to pay Impositions directly, Grantor shall deliver to American within <br />30 days of making each such payment evidence of such payment in the <br />form of the original or a pnotostatic copy of the official receipt <br />evidencing such payment or other proof of payment satisfactory to <br />American. The failure of Grantor to deliver receipts or to submit <br />other proof satisfactory to American as specified above shall consti- <br />tute a default under this Deed of Trust. <br />(C) In the event Grantor shall not fully comply with <br />the terms and conditions of Paragraphs 2 or 3, American may at its <br />option make payment of the items mentioned in such Paragraphs, and <br />Grantor agrees to repay upon demand all funds hereafter advanced by <br />American for such payments, with interest on such payments from the <br />date of such payments until repaid at the default rate set forth in <br />the Note, all of which advances so made by American and interest <br />shall be and become part of the Obligation secured by this Deed or <br />Trust. <br />5. Grantor shall not commit waste or permit waste to be <br />committed on the Property and shall keep all improvements on the <br />Property, including trees, shrubs, fences, irrigation equipment, and <br />buildings in good condition and repair. Grantor shall ooserve com- <br />mercially acceptable practices in operating the Property. <br />6. Grantor shall comply with all laws, ordinances, and <br />regulations affecting the Property or its use and shall faithfully <br />comply with the terms and conditions of all leases (federal, state, <br />and private) and insurance policy provisions now or hereafter in <br />effect, made by or for the benefit of Grantor, for use in connection <br />with the operation of the Property. <br />-4- <br />0 <br />0 <br />
