requirement that Grantor make payments to the Escrow Fund as provided I below and payments are required to be made into the Escrow Fund by Grantor, to the extent such payments are actually made, American shall pay those taxes and charges to the appropriate authority or party on behalf of Grantor. If the amount of the Escrow Fund shall exceed the amounts actually due, American shall, in its sole and absolute discretion to the extent permitted by law, return any excess to Grantor, or credit such excess against future payments to be made to the Escrow Fund, or apply the excess to the reduction of the Obligation. In allocating such excess, American may deal with the person shown on the records of American to be the owner of the Property. (b) American may, in its sole discretion, for any period of time and on any terms and conditions, waive in writing the requirement that Grantor make the monthly payments to the Escrow Fund and allow Grantor to pay directly to the appropriate autnorities or institutions such Impositions. In the event American allows Grantor to pay Impositions directly, Grantor shall deliver to American within 30 days of making each such payment evidence of such payment in the form of the original or a pnotostatic copy of the official receipt evidencing such payment or other proof of payment satisfactory to American. The failure of Grantor to deliver receipts or to submit other proof satisfactory to American as specified above shall consti- tute a default under this Deed of Trust. (C) In the event Grantor shall not fully comply with the terms and conditions of Paragraphs 2 or 3, American may at its option make payment of the items mentioned in such Paragraphs, and Grantor agrees to repay upon demand all funds hereafter advanced by American for such payments, with interest on such payments from the date of such payments until repaid at the default rate set forth in the Note, all of which advances so made by American and interest shall be and become part of the Obligation secured by this Deed or Trust. 5. Grantor shall not commit waste or permit waste to be committed on the Property and shall keep all improvements on the Property, including trees, shrubs, fences, irrigation equipment, and buildings in good condition and repair. Grantor shall ooserve com- mercially acceptable practices in operating the Property. 6. Grantor shall comply with all laws, ordinances, and regulations affecting the Property or its use and shall faithfully comply with the terms and conditions of all leases (federal, state, and private) and insurance policy provisions now or hereafter in effect, made by or for the benefit of Grantor, for use in connection with the operation of the Property. -4- 0 0
