85-'= 001449 <br />TRIPLE NET LEASE <br />WHEREAS, Garst Research Farms, Inc., a Nebraska corporation, <br />is the owner of the following - described real estate: <br />A tract of land in the Southeast Quarter (SE 1/4) of <br />Section 27, Township 11 North, Range 11 West of the <br />6th P.M., Hall County, Nebraska, being more particularly <br />described as follows: Beginning at the Southwest corner <br />of said SE 1,'4; thence running 'dortherly on the West <br />line of said SE 1/4 on an assumed bearing of N 000 00' <br />00" E a distance of 660 feet; thence running S 89° 50' <br />24" E a distance of 660.00 feet; thence running S 00° <br />00' 00" w a distance of 660.00 feet to a point on the <br />South line of said SE 1/4; thence running N B9° 50' 24" <br />W on the South line of said SE 1/4 a distance of 660 <br />feet to the point of beginning, except all mineral lands <br />should any be found to exist in the subject property <br />(said exception shall not be construed to include coal <br />and iron land) and all rights and easements in favor of <br />the estate of said minerals. <br />and <br />WHEREAS, Garst Seed Company, an Iowa corporation, desires to <br />lease the afore- described on the terms hereinafter set forth; <br />NOW, THEREFORE, Garst Research Farms, Inc., a Nebraska cor- <br />poration ( "L-�ssor ") does hereby lease to Garst Seed Company, an <br />Iowa corporation ( "Lessee ") the above- described property under <br />the following terms: <br />1. The terns of the Lease shall commence March 2 ^, 1905 ar-.d <br />end February 28, 1986. <br />2. Rent shall be an amount equal to all operating expenses <br />of the Lessor, with the exception of the rent payable under the <br />Farm Lease filed as Document No. 83- 005057, payable as requested <br />by the Lessor. <br />3. This shall be a Triple Net Lease to Lessor and the <br />Lessee shall be responsible for all taxes, insurance, main- <br />tenance, repairs, and expenses. Breach of any the foregoing <br />obligations shall entitle the Lessor to the same remedy as non- <br />payment of rent. <br />4. Breach of any of the terms hereof, including the non- <br />payment of rent, shall, unless cured within thirty (30) days <br />after notice in writing, entitle the Lessor to terminate the <br />Lessee's right to possession and all other rights hereunder <br />without any further notice.
