BORKERT, husband <br />each in their own right and as and wife, <br />spouse of the other, herein called <br />the Grantors, for and in consideration of the satisfaction of <br />debt owing to Grantee, do grant, bargain, sell, convey and <br />confirm unto NEBRASKA INVESTMENT FINANCE AUTHORITY, formerly <br />known as NEBRASKA MORTGAGE FINANCE F[1ND, herein called the <br />Grantee. the fOilowing- described real estate in Hall County, <br />Nebraska: <br />Lot Five (5), Le Heights Fourth Subdivision, <br />comprising a part of the East Half of the <br />Northwest Quarter (E�NWk) of Section Eleven <br />(11), Township Eleven (11) North, Range Ten <br />(10) , West of the Sixth (6th) Principal <br />Meridian, Hall County, Nebraska, <br />TO HAVE AND TO HOLD the premises above - described, together <br />with all the tenements, hereditaments and appurtenances thereunto <br />belonging, unto the said Grantee and to Grantee's successors and <br />assigns forever. And Grantors herebv covenant with the said <br />Grantee, and with Grantee's successors and assigns, that Grantors <br />are lawfully seized of said premises; that they are free from <br />encumbrance, with the sole exception of the r-ic.rtgage to The <br />Overland National Bank of Grand Island with an Assignment of that <br />Mortgage to Nebraska Mortgage Finance Fund filed of record <br />March 21, 1981, as Document No. 81- 001490, and real estate taxes <br />for the year 1984; and that Grantors have good right and lawful <br />authority to sell the same; and Grantors hereby covenant to <br />warrant and defend the title to said premises against the lawful <br />claims of all persons whomsoever. And the said Grantors hereby <br />relinquish all right, title, claim and interest in and to the <br />above - described premises. <br />This Warranty Deed is given as an absolute conveyance, the <br />Grantors having conveyed said land to the Grantee for a fair and <br />adequate consideration, such consideration being the satisfaction <br />Of obligations secured by the Mortgage assumed by the Grantors <br />Pursuant to a Mortgage Assumption Agreement dated August 4, 1982, <br />which Mortgage in favor of The Overland National Bank of Grand <br />Island and assigned to Grantee was recorded as Document No. <br />81- 001490 in the office of the Register of Deeds of Hall County, <br />Nebraska.
