85- 00124 8 <br />PUBLIC UTILTTY EASEMENT <br />RILEY W. OSBORN and CATHERINE A. OSBORN, husband and wife, <br />each in his and her own right and as spouse of the other, of <br />Grand Island, Nebraska, herein called the Grantors, in <br />consideration of <br />Fifty Five and 62/100 dollars ($55.62) <br />receipt of which is hereby acknowledged, hereby grant and convey <br />unto the <br />CITY OF GRAND ISLAND, NEBRASKA <br />a municipal corporation, in Hall County, Nebraska, herein called <br />the Grantee, a permanent and perpetual easement and right -of -way <br />to construct, operate, maintain, extend, repair, replace, and <br />remove public utilities, including but not limited to, sanitary <br />sewers, storm drainage system, manholes, surface markers, and <br />other appurtenances, upon, over, in, and through a tract of land <br />located in Lot Thirty -one (31), Capital Heights Seventh <br />Subdivision in the City -f Grand Island, Nebraska, more <br />particularly described as follows: <br />The northerly three and one -half (3 1/2) feet of the <br />southerly thirteen and one -half (13 1/2) feet of Lot 31, <br />except the easterly eight (8) feet of said Lot 31, Capital <br />Heights Seventh Subdivision, said tract containing 366 <br />square feet, more or less, as shown on the drawing dated <br />10/15/84, marked Exhibit "A" attached hereto and <br />incorporated herein by reference; <br />together with the following rights, namely, unrestricted ingress <br />and egress under, over, and across such land for the purpose of <br />exercising the rights herein granted, to clear and keep clear of <br />trees, roots, brush, and other obstructions from the surface of <br />such tract.
