1 <br />LEASE AGREEMENT 85-001175 <br />THIS LEASE AGREEMENT is made this 1st day of March, 1985, by and <br />between Howard S. Hinman, Conservator for the Estate of Helen Lane, a <br />Protected person, hereinafter called LANDLORD, and Gangwish Seed Farms, <br />Inc., hereinafter called TENANT. <br />IN CONSIDERATION OF the mutual covenants and agreements contained <br />herein, LANDLORD hereby leases to TENANT, and TENANT hereby leases from <br />LANDLORD, the following real estate: <br />Township 10 North, Range 12 West <br />Section 32: SE 4, except a small tract in the corner of said <br />quarter section lying north of U. S. Highway 30 <br />Township 9 North, v-- -e 12 West <br />Section 5: NE /4 <br />Hall County, Nebraska <br />on the following terms and conditions: <br />1. TERM. The Term of this lease shall be from March 1, 1985, to <br />February 28, 1986, and TENANT agrees to promptly yield up possession of <br />the said premises, at the expiration of the said term, without notice, <br />in as good a repair as the premises now are, ordinary wear and loss by <br />fire excepted. <br />2. RENT. The Rent for the lease term explained in the foregoing <br />paragraph shall be $39,260, payable by the TENANT to the LANDLORD one - <br />half on March 1, 1985, and the other one -half on December 1, 1985. <br />3. PERSONAL PROPERTY INCLUDED: The Lease of the real property <br />described above shall include any improvements located upon the said real <br />Property premises, including the grain storage buildings, irrigation wells, <br />Pumps and power units. Repairs to the power units and grain storage build- <br />ings shall be the obligation of the TENANT. It shall be the duty of the <br />LANDLORD to maintain and repair (or to reimburse the TENANT for any repair <br />or maintenance performed or paid by it) after Notice to the LANDLORD, <br />any of the remaining personal property or fixtures including the irrigation <br />wells and pumps. <br />4. WEEDS. It shall be the responsibility of the TENANT to keep the <br />cultivated lands included within this Lease free from weeds, and also to <br />destroy all weeds, before they ripen their seeds, from along the fences, <br />around the buildings, along the borders of the fields, and along U. S. High- <br />way 30 where it touches the leased land described herein. <br />5. ASSIGNMENT. TENANT does not have the right to assign this Lease <br />Agreement or sublet the premises in any manner, without the written consent <br />of the LANDLORD. <br />6. ENTRY OF PREMISES. LANDLORD shall have the unrestricted right <br />to enter the leased premises at any time, without notice, for the <br />Of emergency repairs and maintenance.
