i <br />ESTOPPEL AFFIDAVIT ,n.. 001160 <br />STATE OF NEBRASKA } <br />ss <br />COUNTY OF HALL ) <br />Sherry L. Johnson, a single person, being first duly sworn, severally, depose and <br />say: <br />That she is the identical party who executed and delivered that certain Warranty <br />Deed to Norwest Bank Grand Island, N. A., dated the 194di day of 1 85 <br />conveying the following- described property: ,•rarc,l ' <br />Lot Fight_ (8) in Block Six (6) in Dale Roush Serond Snbdivisinn, <br />Hall County, Nebraska. <br />That the aforesaid Deed was an absolute conveyance of the title to said premises to <br />the Grantee named therein in effect, as well as in form, and was not and is not now <br />intended as a mortgage, trust conveyance, or security of any kind, and that possession <br />of said premises has been surrendered to the said Grantee; that the consideration in <br />the aforesaid Deed was and is the release of personal liability from the Promissory <br />Notes and Mortgages recorded as Document #84- 002639; that the amount of liability <br />released equals or exceeds the value of the above - described real estate; and receipt <br />of said consideration is hereby acknowledged by said Grantors. <br />The aforesaid Deed of conveyance was made by her as the result of her request that <br />the Grantee accept such Deed and was their free and voluntary act; that at the time <br />of making said Deed she felt and still feels that the indebtedness above mentioned <br />representing the principal, interest and advances under the terms of the Notes and <br />Mortgages above referenced, represented a fair value of the property so deeded; that <br />said Deed was not given as a preference against any other creditors; that at the <br />time it was given there was no other person or persons, firms or corporations, other <br />than the Grantee therein named interested, either directly or indirectly, in said <br />premises; that they are solvent and have no other creditors whose rights would be <br />prejudiced by such conveyance, and that they are not obligated upon any bond or other <br />mortgage whereby any other lien has been created or exists against the premises de- <br />scribed in said Deed; and that in order to execute the aforesaid Deed to the Grantee <br />therein, and in executing the same, she was not acting under any misapprehension <br />as to the effect thereof, or under any duress, undue influence, or misrepresentation <br />by the Grantee or the agent or attorney of the Grantee in said Deed, and that it was <br />her intention as Grantors in said Deed to convey and by said Deed dial convey therein <br />all her right, title, and interest, absolutely, in and to the premises in said Deed. <br />This Affidavit is made for the protection and benefit of the aforesaid Grantee in <br />said Deed, its successors and assigns, and all other parties hereafter dealing with <br />or who may acquire an interest in the property described therein, and shall bind <br />the heirs, personal representatives, and assigns of the undersigned. <br />rry J <br />STATE OF NEBRASKA <br />ss <br />COUNTY OF HALL ) <br />7 rfanl� <br />On this 19131 day of Febr, 1 85, before me a Notary Public, in and for said <br />County and State, personal.l.y appeared Sherry Johnson, 'a single person, to me <br />known to be the person named in and who executed the foregoing instrument, and <br />acknowledged that she executed the same -A her io* l <br />i <br />._.�_. <br />My commission expires: <br />M <br />tt'a <br />i <br />
