BOND, husband and wife, being first duly sworn, <br />jointly and severally, depose and say: <br />That they are the identical parties who executed and delivered that certain Warranty <br />Deed to Norwest Bank Grand Island, N. A. , dated the � 7' "day of f >,;; ,.,Y y 1985, <br />conveying the following- described property: <br />Lots One (1) and Two (2), in Block Four (4) of Blain <br />Addition, an Addition to the City of Grand Island, Nall <br />County, Nebraska. <br />That the aforesaid Deed was an absolute conveyance of the tithe to said premises to <br />the Grantee named therein in effect, as well as in form, and was not and is not now <br />intended as a mortgage, trust conveyance, or security of any kind, and that possession <br />of said premises has been surrendered to the said Grantee; that the consideration in <br />the aforesaid Deed was and is the release of personal liability from the Promissory <br />Notes, Mortgages, Financing Statement, and Trust Deeds, recorded in the Office of <br />the Register of Deeds of Hall County, Nebraska, identified as follows: Mortgage in <br />Book 167, page 163; Financing Statement, Document No. 79- 001233; Mortgage, Document <br />No. 79-001234; Mortgage, Document No. 79- 007718; Trust Deed, Document No. 83- 001342; <br />and Trust Deed, Document Nd. 83- 006078; that the amount of liability released <br />equals or exceeds the value of the above- described real estate; and receipt of said <br />consideration is hereby acknowledged by said Grantors. <br />The aforesaid Deed of conveyance was made by them as the result of their request <br />that the Grantee accept such Deed and was their free and voluntary act; that at <br />the time of making said Deed they felt and still feel that the indebtedness above <br />mentioned representing the principal, interest and advances under the terms of the <br />Notes, Trust Deeds, and Mortgages above referenced, represented a fair value of <br />the property so deeded; that said Deed was not given as a preference against any <br />other creditors; that at the time it was given there was no other person or persons, <br />firms or corporations, other than the Grantee therein named interested, either <br />directly or indirectly, in said premises; that they are solvent and have no other <br />creditors whose rights would be prejudiced by such conveyance, and that they are <br />not obligated upon any bond or other mortgage whereby any other lien has been <br />created or exists against the premises described in said Deed; and that in orde- <br />to execute the aforesaid Deed to the Grantee therein, and in executing the same, <br />they were not acting under any misapprehension as to the effect thereof, or under <br />any duress, undue influence, or misrepresentation by the Grantee or the agent or <br />attorney of the Grantee in said Deed, and that it was their intention as Grantors <br />in said Deed to convey and by said Deed did convey therein all their right, title, <br />and interest, absolutely, in and to the premises in said Deed. <br />This Affidavit is made for the protection and benefit of the aforesaid Grantee in <br />said Deed, its successors and assigns, and all other parties hereafter dealing with <br />or who may acquire an interest in the property described therein, and shall bind <br />the heirs, personal representatives, and assigns of the undersigned. <br />i <br />STAN 'Y W. <br />JOYCL K. 1 i- <br />57'A'ih� OF NEBRASKA ) <br />g9. <br />COUNTY OF 11A1.1, } <br />1h <br />On thi.s � day of //e�v%ne,,'y 1985, be:lore met a Notary hiblic, in and for <br />said Gotmit. illd State, ersonallN pl') <br />Y c I _ y aplx�;lred S'1'AN1.J.Y W. }iOND ruul JOYCE' K.
