85� 001024 <br />land, belonging or in any wise appertaining thereto, including, <br />without limitation, the entire right, title and interest of <br />Grantor in, to and under any streets, ways, alleys, gores or <br />strips of land adjoining said land, and all claims or demands <br />whatsoever of Grantor either in law or in equity, in possession <br />or expectancy, of, in and to said land, it being the intention <br />of the parties hereto that, so far as may be permitted by law, <br />all property of the character hereinabove described, which is <br />now owned or is hereafter acquired by Grantor and is affixed <br />or attached or annexed to said land, shall be and remain or <br />become and constitute a portion of said land and the security <br />covered by and subject to the lien of the Deed of Trust <br />(the "Mortgaged Premises "), together with all accessions, parts <br />and appurtenances appertaining or attached thereto and all sub- <br />stitutions, renewals or replacements of and additions, improvements, <br />accessions and accumulations to any and all thereof, and together <br />with all rents, income, revenues, awards, issues and profits <br />thereof, and the present and continuing right to make claim for, <br />collect, receive and receipt for any and all of such rents, <br />income, revenues, awards, issues and profits arising therefrom <br />or in connection therewith. <br />SECTION 1. DEFINITIONS. <br />The definitions of the terms used in the Deed of Trust, <br />and the use thereof in the Deed of Trust, as amended by this First <br />Amendment are hereby amended as follows: <br />(a) Each reference to the term "Crude 011 Sales <br />Agreement" shall be deemed to include the terms and provisions <br />of the Restated Crude 011 Sales Agreement. <br />(b) The definition of the term "Debt" set forth in the <br />seventh grammatical paragraph of the Deed of Trust shall be deemed <br />to include any obligation to Beneficiary for sales of crude oil and <br />crude oil products and blends to Pester Refining Company (including <br />the SURCO Note) and any obligation of Grantor under the Guaranty <br />in addition, to the obligations set forth in such paragraph. <br />SECTION 2. REPRESENTATIONS AND WARRANTIES. <br />Grantor represents and warrants to the Beneficiary <br />that all of the representations and warranties set forth in the <br />fourth grammatical paragraph of the Deed of Trust are true and <br />correct as of the date hereof as if made on the date hereof and <br />set forth in full in this First Amendment. <br />SECTION 3. <br />RELEASE OF INDEBTEDNESS. <br />The fifth grammatical paragraph of the Deed of Trust <br />beginning "PROVIDED, ALWAYS" is deleted in its entirety and <br />replaced with the following: <br />9 <br />X <br />J <br />x� <br />
