<br />MEPARANDUM OF RENTAL POOL AGREEMENT
<br />This Memorandum of Rental Pool Agreement ( "Memorandum "), made and entered into as of this
<br />day of December, 1984, by and between the undersigned purchaser of a condominium
<br />apartment unit(s) ( "Owner ") and Devco Investment Corporation, a Nebraska corporation ( "Agent "),
<br />is made with reference to the following:
<br />A. This Memorandum is to indicate that the Owner and Agent executed a Rental Pool
<br />Agreement dated December `,l , 1984, for The Yancey Condominium, Grand Island, Nebraska,
<br />encumbering the real estate described, to wit (the "Unit "):
<br />Condominium Unit(s) No. 606, The Yancey, a Condominium,
<br />A Condominium in accordance with the Declaration recorded on
<br />October 17, 1984, under Document No. 84- 005507 of the County of
<br />Hall, State of Nebraska, records.
<br />B. A copy of an unexecuted Rental Pool Agreement is incorporated as Exhibit "R" to the
<br />Declaration, recorded on October 17, 1984, under Document No. 84- M15507 of the County of Hall,
<br />State of Nebraska, records.
<br />C. The Rental Pool Agreement executed by the Owner and Agent states that until June 30,
<br />1990, the Unit(s) shall be rented, leased and subleased through and placed in the The Yancey
<br />rental pool in accordance with the terms and conditions as defined in the Rental Pool Agreement.
<br />D. The Rental Pool Agreement also states that unless the Owner reserves the right to have
<br />the Units) occupied by the Owner or the Owner's iamnediate family, business clients or employees
<br />(hereinafter referred to as "Personal Use "), thy• t'aner shall participate in the rental pool
<br />subject to certain terms and conditions a defined in he Rental Pool Agreement.
<br />E. The Owner designates the Agent as the exclusive agent on behalf of the Owner to manage
<br />the rental, leasing and subleasing of the Unit(s) until June 30, 1990, subject to the terms and
<br />conditions as defined in the Rental Pool Agreement.
<br />F. All notices, demands, inquiries or documents that are permitted or required to be given
<br />or served hereunder shall be in writing and shall be served by certified or registered mail,
<br />posting prepaid to the Owners at the address appearing below, and to the Agent at the address
<br />appearing below. Such addresses may be changed from time to time by either party by serving
<br />notice as provided above.
<br />The Agent and undersigned Owner have executed this P.ental Pool Agreement on the day and year
<br />first above written.
