<br />SPECIAL WARRANTY DEED
<br />1. The City of Grand Island, Nebraska, by action of its
<br />City Council on January 14, 1985, enacted Ordinance no. 7148,
<br />which directed the conveyance of the real estate described below
<br />and the manner and terms thereof.
<br />2. Ordinance No. 7148 was published in the Grand Island
<br />Daily Independent according to law, and notice of such sale and
<br />the terms thereof were published in the Grand Island Daily Inde-
<br />pendent for three successive weeks, on January 22, January 29, and
<br />February 5, 1985, all as required by Section 16 -202, R.R.S. 1943.
<br />3. No remonstrance against such sale was filed with the
<br />City Council of the City of Grand Island, Nebraska, within thirty
<br />days of the passage and publication of Ordinance No. 7148.
<br />4. Section 5 of Ordinance No. 7148 provides that if no
<br />remonstrance be filed against such conveyance, the Mayor and City
<br />Clerk shall make, execute and deliver to the Grantee a Special
<br />Warranty Deed for said real estate, and the execution of such deed
<br />is hereby authorized without further action on behalf of the City
<br />Council.
<br />NOW, THEREFORE, the City of Grand Island, Nebraska, a
<br />municipal corporation in Hall County, Nebraska, as Grantor, in
<br />consideration of Two Thousand One Dollars ($2,001.00) received
<br />from Grantees, does hereby grant, bargain, sell, convey, and
<br />confirm unto
<br />JAMES G. DUDA and DEBRA L. DUDA,
<br />husband and wife, as joint tenants and not as tenants in common,
<br />herein called the Grantees, the following described real property
<br />in Hall County, Nebraska:
<br />Lot Seven (7), and the South seventy -seven feet (S77') of Lot
<br />Eight (8), Block Sixteen (16), Original Town, now City of
<br />Grand Island, Nebraska,
<br />hereinafter referred to as the Premises.
<br />To have and to hold the above described Premises unto the
<br />Grantees and to Grantees' heirs, devisees, executors, admini::-
<br />trators, successors, and assigns forever, so long as the Grantees
<br />perform all of the covenants and obligations contained in para-
<br />graph 6 of the "Agreement: for Purchase of Real Estate" recorded as
<br />Document No. 84- 006507 in the office of the Register of Deeds of
<br />Hall County, Nebraska.
<br />This Special Warranty Deed shall convey to Grantees an estate
<br />in fee simple determinable, and in the event of breach of any of
<br />the provis.iony of paragraph 6 of the foregoing Agreement for
