<br />THIS DEED OF TRUST, is made as of the 19 day of
<br />February, 1985, by and among Douglas A. Davis nd^Kathryn J.
<br />Davis, husband and wife, as joint tenants with right of survivor-
<br />ship, ( "Trustor "), whose mailing address is 1910 Stolley Park
<br />Road, Grand Island, Nebraska, The Omaha National Bank of Grand
<br />Island, Grand Island, Nebraska, ( "Trustee "), whose mailing
<br />address is 424 West Third Street, Grand Island, Nebraska 68801,
<br />and Roy H. Scheel and Donald R. Scheel, as joint tenants with
<br />right of survivorship and not as tenants i.� common ( "Ben�r�

<br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers,
<br />conveys and assigns to Trustee, IN TRUST, WITH POWER OF SALE,
<br />for the benefit and security of Beneficiary, under and subject
<br />to the terms and conditions of this Deed of Trust, the real
<br />property, located in the City of Grand Island, County of Hall,
<br />State of Nebraska, and described as follows (the "Property "):
<br />Part of the Southwest Quarter of the Southwest Quarter
<br />(SASW4) of Section Twenty -one (21), Township Eleven
<br />(11) North, Range Nine (9), West of the 6th P.M., Hall
<br />County, Nebraska, more particularly described as
<br />follows: Commencing at a point Two hundred eighty-
<br />three and three - tenths (283.3) feet west of the South-
<br />east corner of the Southwest Quarter of the South -hest
<br />Quarter (SW4SW4) of Section Twenty -one (21), running
<br />thence north and in a line parallel with the east
<br />boundary line of said Southwest Quarter of the South-
<br />west Quarter (SkSW4), a distance of Two hundred forty
<br />and seven - tenths (240.7) feet, thence at right angles
<br />and in a westerly direction one hundred twenty (120)
<br />feet, thence at right angles and in a southerly direc-
<br />tion Two hundred forty and seven - tenths (240.7) feet,
<br />thence at right angles and in an easterly direction
<br />One hundred twenty (120) feet to the place of begin-
<br />ning, subject, however, to the highway right -of -way
<br />over the southerly Thirty -three (33) feet thereof.
<br />TOGETHER WITH, all rents, easements, appurtenances, here -
<br />ditaments, interests in adjoining roads, streets and alleys,
<br />improvements and buildings of any kind situated thereon and all
<br />personal property that may be or hereafter become an integral
<br />part of such buildings and improvements, all crops raised there-
<br />on, and all water rights.
<br />The Property and the entire estate and interest conveyed to
<br />the Trustee are referred to collectively as the "Trust Estate."
<br />FOR THE PURPOSE OF SECURING:
<br />a. Payment of: indebtedness in the total principal amount
<br />of $39,000.00, with interest thereon, as evidenced by that
<br />certain promissory note of even date (the "Note ") with a matur-
<br />ity date of April 1, 1990, executed by Trustor, which has been
<br />delivered and is payable to the order of Beneficiary, and which
<br />by this reference is hereby made a part hereof, and any and all
<br />modifications, extensions and renewals thereof, and
<br />b. Payment of al.l sums advanced by Beneficiary to protect
<br />the Trust Estate, with interest thereon at the rate of eight
<br />percent (8%) per annum.
