F_ 7 00071M ASSIGNMENT OF CONTRACT FOR SALE OF REAL ESTATE We, Norman S. Mieth and Judy L. Mieth, husband and wife, hereby assign to Margaret M. Quaring, Clarice E. Wilcox, the Stuart W. Mieth Trust, Carol M. Mieth, Trustee and Ramon L. Mieth, all our rights under that certain Contract for Sale of Real Estate dated December 2, 1983, by and between Norman S. Mieth and Judy L. Mieth, Sellers and Steven D. Hansen and Cynthia E. Hansen, Buyers, covering the sale of the following described real estate: A tract of land comprising a part of the SwiNWi and part of the NWiSWi of Section 4, Township 11 North, Range 12 West of the 6th P.M., in Hall County, Nebraska, more particularly described as follows: Beginning at the Southwest corner of said NWi; thence northerly along the west line of said Section 4 a distance of 486.37 feet; thence deflecting right 880 30' 17" and running easterly a distance of 737.33 feet; thence deflecting right 1030 57' 23" and running southwesterly a distance of 655.82 feet; thence deflecting right 75° 37' 23" and running westerly a distance of 595.67 feet, to the west line of said Section 4; thence northerly along the west line of said Section 4 a distance of 154.73 feet to the place of beginning, together with all improvements located thereon. It is understood this Assignment is for the purpose of securing that certain Mortgage and Note which Assignor Norman S. Mieth and his then wife, Sherri L. Mieth, executed in favor of the Everett S. and Augusta C. Mieth Revocable riving Trust Agreement, dated July 14, 1975 in the original amount of $30,000.00, said note dated January 31, 1981 and by the successor trustee of said trust, distributed to the heirs thereof, assignees herein. It is further understood the unpaid balance of the Norman S. and Sherri L. Mieth mortgage to the assignees herein is in the amount of $26,874,66 on this date and that said amount is less than the amount due assignors from the Steven D. and Cynthia E. Hansen contract. At such time as the said Norman S. Mieth and Sherri L. Mieth mortgage note in the present amount of $26,874,66 is paid in full, together with interest, this Assignment shall become null and void.
