85- .000530 <br />AFFIDAVIT <br />The undersigned, Warren Malstrom, being first duly sworn <br />upon oath, deposes and states: <br />1. He is identified as Trustor and Beneficiary in respect <br />to a document entitled "Deed of Trust" dated October 10, 1984, <br />which he executed and caused to be filed of record in the Office <br />of the Register of Deeds of Hall County, Nebraska, as Document <br />No. 84- 005369 against that real estate described as: 1321 North <br />Sheridan Place, Lot Fifteen (15), Imperial Village Third Sub- <br />division, Grand Island, Hall County, Nebraska. <br />2. The Trustee, identified in such Deed of Trust as the <br />"Keeper of Records ", is not qualified to act as a trustee under <br />the provisions of the Nebraska Trust Deeds Act §76 -1003, and by <br />reason thereof, the attempted conveyance to secure debt, as <br />recited therein, was wholly ineffective and invalid. <br />3. At the time of the purported conveyance by Deed of <br />Trust, the undersigned Affiant did not have a fee simple interest <br />in the property herein - described and had no power or authority to <br />subject the described real estate to a Deed of Trust, and has now <br />caused the purported indenture to be released of record. <br />Further Affiant saith not. <br />Warren Malmstrom <br />STATE OF NEBRASKA 1 <br />1 <br />COUNTY OF <br />Before me, a Notary Public qualified for said County, <br />personally came Warren Malmstrom, known to me to be the identical <br />person who signed the foregoing Affidavit and acknowledged the <br />execution thereof to be his voluntary act and deed. <br />Witness my hand and Notarial Seal on 4 _ <br />19 <br />~ Notary Public <br />
