85- .000530 AFFIDAVIT The undersigned, Warren Malstrom, being first duly sworn upon oath, deposes and states: 1. He is identified as Trustor and Beneficiary in respect to a document entitled "Deed of Trust" dated October 10, 1984, which he executed and caused to be filed of record in the Office of the Register of Deeds of Hall County, Nebraska, as Document No. 84- 005369 against that real estate described as: 1321 North Sheridan Place, Lot Fifteen (15), Imperial Village Third Sub- division, Grand Island, Hall County, Nebraska. 2. The Trustee, identified in such Deed of Trust as the "Keeper of Records ", is not qualified to act as a trustee under the provisions of the Nebraska Trust Deeds Act §76 -1003, and by reason thereof, the attempted conveyance to secure debt, as recited therein, was wholly ineffective and invalid. 3. At the time of the purported conveyance by Deed of Trust, the undersigned Affiant did not have a fee simple interest in the property herein - described and had no power or authority to subject the described real estate to a Deed of Trust, and has now caused the purported indenture to be released of record. Further Affiant saith not.
