STATE OF NEBRASKA <br />ss. <br />COUNTY OF HALL <br />JOHN A. WAGONER, being first duly sworn on oath, d4poses <br />and states that he is an attorney at law and has practiced law <br />in Hall County, Nebraska for more than 40 years last past; that <br />Affiant was well and personally acquainted with Leona A. O'Brien# <br />also known as Leona Alta O'Brien. <br />That on December 7, 1977, Affiant prepared a Survivorship <br />Warranty Deed, at Decedent's request, by which she conveyed the <br />following described real estate to her son and daughter-in-law, <br />Stanley K. O'Brien and Donnie O'Brien, husband and wife, as <br />joint tenants, in which Warranty Deed, recorded as Document <br />#77-007066 in the office of the Register of Deeds, Hall County, <br />Nebraska, the said decedent reserved a life estate: <br />A Part of Lot One (1) of the County Subdivision of the <br />Northwest Quarter (NW4), and the West Half of the North- <br />east Quarter (WJINB ) of Section Five (5), in Township <br />Ten (10), North, Range Ten (10), West of the 6th P.M., <br />a Point on the Southwest Corner of Lot One (1) in the <br />County Subdivision of the Northwest Quarter (NW4) and <br />the West Half of the Northeast Quarter (WhNEk) of Sec- <br />tion Five (5) in Township Ten (10), North of Range Ten <br />(10), West of the 6th P.M., Thence running in an Easterly <br />Direction along the Northerly Line of the U.P. Railroad <br />Company's Right-of-Way Eighteen (18) Rods; thence running <br />in a Northwesterly Direction Twenty-Three (23) Rods & <br />One Foot, Thence in a Southwesterly Direction Four (4) <br />Rods & eight Feet to the Easterly Line of the East Street <br />in Powell's Addition to the Village of Aida, Nebraska, <br />Thence South to the Place of Beginning, Containing One <br />and Half Acres, More or Less, According to Measurement. <br />That said Decedent died at Grand Island, Nebraska on February 9, <br />1980, and that the above real estate was the only real estate owned <br />by said Decedent at the date of the gift of the same to her son and <br />daughter-in-law and that, to the best of Affiant's knowledge and <br />belief, the said Decedent owned no other property at the date of <br />her death other than her life estate in the above real property. <br />Dr, <br />M <br />
