I <br />1 <br />AFFIDAVIT OF INDIVIDUALS GIVING <br />DEED IN LIEU OF FORECLOSURE <br />STATE OF IOWA ) <br />) ss. <br />COUNTY OF _ } 2 t ) <br />Brian K. Rasco and Regina G. Rasco, Husband and Wife, <br />being first duly sworn, depose and say as follows? <br />1. They are the identical parties who purchased <br />property from Bruce A. Kottwitz and Peggy j. Kottwitz, <br />Husband and Wife, and that in connection therewith, on May <br />17, 1983, the undersigned executed a. Promissory Note and <br />Mortgage to Rothchild Financial Corporation of St. Paul, <br />Minnesota in consideration of the sum of Forty -three <br />Thousand, Two Hundred Dollars ($43,200.00). <br />2. This was in connection with the following described <br />real property: <br />Fractional Lot Four (4) of the County Subdivision <br />of Lots Thirteen (13) and Sixteen (16) and Part of <br />Lots Eight (8) , Eleven (11), Twelve (12) and <br />Fourteen: (14) of County Subdivision of Southeast <br />Quarter Southwest Quarter (SW1 /4SW1/4), Section <br />Sixteen (16), Township Eleven (11) North, Range <br />Paine (9) West of the 6th P.M., and Fractional Lot <br />Five (S) in Fractional Block Eight (8) in Elm <br />Place Addition to the City of Grand Island, Hall <br />County, Nebraska. <br />3. That Affiants now are and at all times herein <br />mentioned have been husband and wife. <br />4. That in the execution of the above referenced note <br />and mortgage, Affiants were not acting under any <br />misapprehension as to the effect thereof and acted freely <br />and voluntarily and were not acting under coercion or <br />duress. <br />a <br />
