<br />SKAG-WAY DISCOUNT DEPT. STORES, INS:. , a Corporation, herein called
<br />Grantor, in consideration of One dollar (11.00) , receipt of which is
<br />hereby acknowledged, hereby grants and conveys unto the
<br />6ITY OF GRAND ISLE, NEBRASKA,
<br />a municipal corporation in Ball County, Nebraska, herein called Grantee, a
<br />permanent and perpetual easement and right-of-way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />underground electrical utility lines, cables, terminals, transformers, surface
<br />markers, and outer appurtenances connected therewith, in, upon, above, along,
<br />across, underneath, and through a sixteen (1$.0) foot wide tract of land
<br />located in part of Lot Six (6), home Subdivision, Grand Island, Hall County,
<br />Nebraska; the centerline of the easement being more particularly described as
<br />follows:
<br />Commencing at the Northeast corner of Lot Six (6), Home
<br />Subdivision; thence South along the East line of said Lot Six
<br />(6), Home Subdivision, a distance of two hundred sixty seven
<br />(267.0) feet to the actual point of beginning; thence
<br />deflecting Right 84 040'36 ", a distance of one hundred fifty
<br />four (154.0) feet; thence deflecting Right 107052'09 ", a
<br />distance of two hundred eighty seven (287.0) feet, to a point
<br />on the North line of said Lot Six (6), Home Subdivision.
<br />Said point being ninety one (91.0) feet West of the Northeast
<br />corner of said Lot Six (6), Home Subdivision.
<br />The above described tract of land containing 0.163 acres,
<br />more or less as shown on the plat dated 12/30/86, marked
<br />Exhibit "A ", attached hereto, and incorporated herein by
<br />reference;
<br />together with the following rights:
<br />Unrestricted ingress and egress to the above described easement tract for
<br />the installation, maintenance, operation, and removal of such underground
<br />electrical utilities and appurtenances.
<br />Such rights of ingress and egress shall include all rights necessary for
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />granted, including the right to excavate and refill ditches and trenches; to
<br />remove, clear, and keep clear trees, bushes, hedges, undergrowth, and other
<br />obstructions interfering with the surveying, construction, inspection,
<br />maintenance, repair, replacement, extension, removal, or operation of such
<br />underground electrical -utilities and appurtenances. No structures, buildings,
<br />fences, or other obstructions of any kind whatsoever shall be allowed in,
<br />upon, above, along, across, underneath, or through the easement herein
<br />granted.
<br />And further provide that the Grantor and the Grantee agree that the
<br />Grantor shall have the right to pave over the easement area, and use the
<br />easement area for parking and ingress and egress; provided, if the Grantee
<br />weeds to construct, .inspect, maintain, repair, replace, extend, remove, or
<br />uperato anyining within such easament., the cost- of removal and repair of An.
