SUBORDINATION AGREEMENT 87- 100105
<br />This Agreement made and entered into this 5 day of JanUary 1987
<br />by and between Chrysler First Financial Services Corporation of Nebraska and
<br />Jerald L. Robertson and Rosalee Robertson, husband and wife, of Hall County,
<br />Nebraska;
<br />WHEREAS, Jerald L. and Rosalee Robertson executed a real estate mortgage to
<br />Sun Way Systems, Inc. on May 24, 1985, which was recorded at 85- 003024 of the
<br />Hall County, Nebraska records. Said mortgage was assigned to Finance America
<br />Corp. of Nebraska now known as Chrysler First Financial Services Corporation
<br />of Nebraska on June 11, 1985. Said mortgage was given to secure payment of
<br />a certain home improvement retail instalment sale agreement against the premises
<br />legally described as follows, to wit: Lot 10, Block 3, First Addition to the
<br />Village (now city), of wood River, Hail County, Nebraska.
<br />WHEREAS, Jerald L. and Rosalee Robertson have given a deed of trust bearing
<br />the date of January 5 , 1987 , and intended for immediate recording to
<br />Norwest Financial Nebraska, Inc. to secure the sum of $ 17,580.00
<br />with interest thereon against the aforesaid premises; and
<br />WHEREAS, it is the purpose and intention of all the parties hereto that the
<br />deed of trust given to Norwest Financial Nebraska, Inc. shall be prior in lien,
<br />effect, operation and payment to the mortgage given to Sun Ray Systems, Inc.
<br />which was assigned to Finance America Corp. of Nebraska now known as Chrysler
<br />First Financial Services Corporation of Nebraska,
<br />NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that said Chrysler First Financial
<br />Services Corporation of Nebraska intending to be legally bound hereby for and
<br />in consideration of the mutual covenants herein contained, does jointly and
<br />severally for itself, its executors, administrators and assigns, covenant and
<br />agree as follows:
<br />that Chrysler First Financial Services Corporation of Nebraska in
<br />the above entitled mortgage given to Sun Ray Systems, Inc. and
<br />assigned to Finance America Corporation of Nebraska now known as
<br />Chrysler First Financial Services Corporation of Nebraska, for value
<br />received, does by these presents subordinate the lien, effect.,
<br />operation and payment of the above - entitled mortgage dated May 24,
<br />1985, and recorded at 85- 003024 aforesaid, and does also
<br />subordinate the lien, effect, operation and payment of the above
<br />mortgage, as entered, to the lien, effect, operation and payment
<br />of such mortgage dated May 24 , 1985, and intended
<br />for immediate recording in the office of the Recorder of Deeds
<br />executed and acknowledged and delivered by said Jerald L. and Rosalee
<br />Robertson, the present owners of the mortgaged premises, to Norwest
<br />Financial Nebraska, Inc. and the indebtedness accompanying said
<br />mortgage, said indebtedness and mortgage being in the sum of
<br />$ 10,000.00 with interest covering the legally described
<br />premises set out above.
<br />IN WITNESS WHEREOF, Chrysler First Financial Services Corporation of Nebraska
<br />formerly known as Finance America Corporation of Nebraska caused these presents
<br />to be duly executed this 5 day of January , 1987 .
