1 0739.9 <br />sold by the taxing authorities because of nonpayment of such tax <br />or assessments. <br />Mortgagors covenant that Mortgagors will not, directly or <br />indirectly, mortgage, pledge or encumber the real estate °or <br />assign or attempt to assign the rents and profits from the real <br />estate other than the lien of this Mortgage. Mortgagors agree <br />Mortgagors will not in any other manner impair or threaten the <br />value of the real estate or the security of Mortgagee. <br />Mortgagors agree not to permit any waste in or about the <br />real estate and not to use the real estate for any purpose <br />increasing the likelihood of fire or other casualties. <br />Mortgagee and Mortgagee's agents shall have the right to <br />inspect the real estate or any part thereof during reasonable <br />hours or at any time if Mortgagors fail to continue in possession <br />of the real estate. <br />Mortgagors agree to notify Mortgagee in writing prior to <br />conducting any major remodeling such as removable of walls, <br />removable of any part of the building or other structural work <br />and to obtain the prior written consent from Mortgagee before <br />starting such remodeling work. Mortgagee shall not unreasonably <br />withhold such written consent for such remodeling. Minor <br />maintenance and repairs by Mortgagors do not require notification <br />to Mortgagee. <br />If Mortgagors default in the performance of this Mortgage <br />and Mortgagee has elected to foreclose the Mortgage for <br />satisfaction of the total amount due to Mortgagee, at any time <br />after the commencement of an action for foreclosing the Mortgage, <br />or during the period of redemption, the Mortgagee shall have the <br />right to have a receiver appointed to take immediate possession <br />of the real estate and of the rents and profits accruing <br />therefrom and to rent the real estate as the receiver may deem <br />best for the interest of all parties concerned. <br />Upon payment of the Promissory Note by Mortgagors according <br />to the terms thereof and performance of all of Mortgagors' <br />obligations under this Mortgage, Mortgagors are entitled to a <br />release in recordable form of this Mortgage and Mortgagee is <br />obligated to file a release in proper form at Mortgagee's <br />expense. <br />All of the rights and remedies reserved to the Mortgagee and <br />all of the obligations herein imposed upon the Mortgagors shall <br />be deemed to run with the land and shall be for the benefit of <br />the successor and assigns of the Mortgagee and shall bind the <br />heirs, Personal Representatives and assigns of the Mortgagors and <br />IN <br />0 <br />___1 <br />
