HANQUIST, husband and wife, GRANTORS, in <br />consideration of a full release of their liability on a certain Mortgage Note ' <br />dated October 9, 1979 in the original principal amount of $30,850-00, which Note <br />is secured by a Mortgage dared October 9, 1979 and recorded as Document No. <br />79- 006589 in the office of the Register of Deeds of fall County, Nebraska hereby <br />voluntarily give and surrender, in lieu of foreclosure, to GRANTEE, The Secretary <br />of Housing and Urban Development of Washington, D.C., its successors and assigns, <br />the following described real estate (as defined in Neb. Rev. Stat. § 76 -201): <br />Lot Sixty Three, in nest Heights Addition to the City <br />of Grand Island, Hall County, Nebraska, a /k /a 415 N. <br />Sherman, Grand Island, Nebraska 68801, <br />together with all appurtenances thereunto belonging. <br />GRANTORS covenant jointly and severally with GRANTEE that ,GRANTORS: <br />(1) are lawfully seised of such real estate and that it is free from <br />encumbrances except for a Mortgage in favor of Mortgage Plus incorporated and <br />now held by New York Guardian Mortgage Corp., it the original principal amount of <br />$30,850.00 as represented by a Mortgage appearing in the office of the Register <br />of Deeds of Hall County, Nebraska as Document No. 79- 006589 and Assignments <br />appearing in the same office as Document Nos. 79- 007609 and 86- 1006011; <br />(P) have legal Dower any' l_awfuT a,fthority convev the same; <br />(3) warrant and will defend title to the real estate against the lawful <br />claims of all persons claiming by or through them; <br />(4) that this conveyance is and does constitute an absolute conveyance <br />of title to the Dremises to the GRANTEE herein and is not intended as a Mortgage, <br />trust conveyance or as security of any kind, and possession of the premises is <br />hereby delivered concurrently; and <br />(5) GRANTORS hereby relinquish all right, `i`le, interest and equity of <br />redemption in and to the above described premises. <br />The filing of this deed by the GRANTEE shalt. constitute acceptance of this <br />deed and as a result thereof, such :,ling shall indico *.e GRANTEE'S intention to <br />release and discharge the GRANTORS from any liability for a deficiency judgment <br />as a result of the Mortgage Note and Mortgage referred to above. <br />Executed December p 1986. <br />D.
