i LIS PENDENS NOTICE OF SUIT 86- -408952 NOTICE IS HEREBY GIVEN that a Petition has been filed in the District Court of Hall County, Nebraska, wherein FirsTier Bank, National Association, Omaha, Nebraska, A National Banking Association, Successor in Interest to Commercial National Bank and Trust Company, is Plaintiff and Richard Wayne Smith, a single person; Hoppe Lumber Company, A Nebraska Corporation; and Hall County, Nebraska, A Body Corporate and Politic are Defendants, the object and prayer of which is to obtain an accounting from said Defendants of the amount due Plaintiff on the mortgage dated the 6th day of June, 1983, and filed in the office of the Register of Deeds, Hall County, Nebraska on the 6th day of June, 1983, as Document / 83- 002854, and on the mortgage dated the 14th day of March, 1984, and filed in the office of the Register of Deeds, Hall County, Nebraska on the 16th day of March, 1984, as document #E 84- 001372, wherein Richard Wayne Smith mortgaged and conveyed to Plaintiff the following described real estate situated in Hall County, Nebraska, to wit: Lots Four (4), Five (5), and Six (6), Shady Lane Subdivision, Hall County, Nebraska and to obtain a foreclosure of said mortgages and to have the same declared a lien upon the interest of FirsTier Bank in said real estate and appurtenances thereto; to have said real estate and appurtenances sold to satisfy the amount so found due, together with the cost of suit, and to foreclose the said Defendants of all right, title, interest, lien, claim, demand and equity of redemption whatever in and to the said real estate and appurtenances thereto, together with such other and further relief as to the Court may seem just and equitable.
