i <br />LIS PENDENS <br />NOTICE OF SUIT 86- -408952 <br />NOTICE IS HEREBY GIVEN that a Petition has been filed in the <br />District Court of Hall County, Nebraska, wherein FirsTier Bank, <br />National Association, Omaha, Nebraska, A National Banking Association, <br />Successor in Interest to Commercial National Bank and Trust Company, is <br />Plaintiff and Richard Wayne Smith, a single person; Hoppe Lumber <br />Company, A Nebraska Corporation; and Hall County, Nebraska, A Body <br />Corporate and Politic are Defendants, the object and prayer of which is <br />to obtain an accounting from said Defendants of the amount due <br />Plaintiff on the mortgage dated the 6th day of June, 1983, and filed in <br />the office of the Register of Deeds, Hall County, Nebraska on the 6th <br />day of June, 1983, as Document / 83- 002854, and on the mortgage dated <br />the 14th day of March, 1984, and filed in the office of the Register of <br />Deeds, Hall County, Nebraska on the 16th day of March, 1984, as <br />document #E 84- 001372, wherein Richard Wayne Smith mortgaged and <br />conveyed to Plaintiff the following described real estate situated in <br />Hall County, Nebraska, to wit: Lots Four (4), Five (5), and Six (6), <br />Shady Lane Subdivision, Hall County, Nebraska <br />and to obtain a foreclosure of said mortgages and to have the same <br />declared a lien upon the interest of FirsTier Bank in said real estate <br />and appurtenances thereto; to have said real estate and appurtenances <br />sold to satisfy the amount so found due, together with the cost of <br />suit, and to foreclose the said Defendants of all right, title, <br />interest, lien, claim, demand and equity of redemption whatever in and <br />to the said real estate and appurtenances thereto, together with such <br />other and further relief as to the Court may seem just and equitable. <br />By <br />NRanF. ssmeier, ;115701 <br />nk, N.
