86-- 106927 3.13 Notices. All parties to this Deed of Trust hereby request that a copy of any notice of default and that a copy of any notice of sale hereunder be mailed to each of them at their respective addresses set forth in the first paragraph of this Deed of Trust. All other notices to be given pursuant to this Deed of Trust shall be sufficient if mailed ,postage prepaid, certified or registered mail, return receipt requested, to the above - described address of the parties hereto, or to' such ` other address as a party may 'request in writing. Any time period provided in the giving of any ;notice hereunder shall commence upon the date such notice is deposited in the mail. Notice to Beneficiary shall be sent to the Beneficiary at 3970 Multifoods Tower, Minneapolis, Minnesota 55402, and the Trustee at, McGill, Koley, Parsonage & Lanphier, P.C., 10010 Regency Circle, Suite 300, Omaha, Nebraska, 68114, or at such other address as may be furnished by such parties in writing. 3.14 Modifications. This Deed of Trust may not be amended, modified or changes nor shall any waiver of any provision hereof be effective, except only by an instrument in writing and signed by the party against whom enforcement of any waiver, amendment, change, modification or discharge is sought. 3.15 Governing Law. This Deed of Trust shall be construed according to and governed by the laws of the State of Nebraska. 3.16 Trust Irrevocable. This Deed of Trust is irrevocable by the Trustor. 3.17 Waiver of Statute of Limitations. So far as lawfully may be, Trustor waives every statute of limitation applicable at any time to any action or proceeding to enforce any obligation hereby secured, or to prevent or redress any breach thereof. 3.18 TRUSTOR PLEASE NOTE: TRUSTOR HEREBY WAIVES ANY RIGHT IT MAY HAVE UNDER THE CONSTITUTION OF THE STATE OF NEBRASKA OR OF THE CONSTITUTION OF THE UNITED STATES OF AMERICA TO NOTICE, OR TO A JUDICIAL HEARING PRIOR TO THE EXERCISE OF ANY RIGHT OR REMEDY PROVIDED BY THIS DEED OF TRUST TO TRUSTEE OR BENEFICIARY AND WAIVES ITS RIGHTS, IF ANY, TO SET ASIDE OR INVALIDATE ANY SALE DULY CONSUMMATED IN ACCORDANCE WITH SECTION 2.02(d)(1) HEREOF ON THE GROUND (IF SUCH BE THE CASE) THAT THE SALE WAS CONSUMMATED WITHOUT A PRIOR JUDICIAL HEARING. TRUSTOR'S WAIVERS UNDER THIS PARAGRAPH HAVE BEEN MADE VOLUNTARILY, INTELLIGENTLY, AND KNOWINGLY AND AFTER TRUSTOR HAS BEEN APPRAISED AND COUNSELED BY ITS ATTORNEYS AS TO THE NATURE THEREOF AND ITS POSSIBLE ALTERNATIVE RIGHTS. -22-
