86--• 1 X 6927 <br />notice is required and cannot be waived, Trustor agrees that as it <br />related to this Paragraph (c) only if such notice is postmarked, <br />postage prepaid, to the Trustor at the above address at least five <br />(5) days before the time of the sale or disposition, such notice <br />shall be deemed reasonable and shall fully satisfy any <br />requirements.for giving of said notice. <br />(d) Upon and after any such Event of Default and during <br />the continuance of such Event of Default, Beneficiary, without <br />further demand on Trustor, may: <br />(1) declare all sums hereby secured immediately due <br />and payable by executing and recording or by. causing the <br />Trustee to execute and record a notice of default and <br />election to cause the property to be sold to satisfy the <br />obligations secured hereby. After delivery to Trustee of <br />applicable law after recordation of a notice of default, <br />Trustee shall give notice of sale as then required by law, <br />and without demand on Trustor, shall sell said property at <br />the time and place of sale fixed by it in said notice of <br />sale, either as a whole or in separate parcels and in such <br />order as it may determine, at public auction to the highest <br />bidder for cash in lawful money of the United States, <br />payable at time of sale; or <br />(2) institute proceedings for the complete or partial <br />foreclosure of this Deed of Trust; or <br />(3) apply to any court of competent jurisdiction for <br />the appointment of a receiver or receivers for the Premises <br />and of all the earnings, revenues, rents, issues, profits <br />and income thereof; or <br />(4) take such steps to protect and enforce its rights <br />whether by action, suit or proceeding in equity or at law <br />for the specific performance of any covenant, condition or <br />agreement in the Credit Agreement, or in this Deed of <br />Trust, or in aid of the execution of any power herein <br />granted, or for any foreclosure hereunder, or for the <br />enforcement of any other appropriate legal or equitable <br />remedy or otherwise as the Beneficiary shall elect. <br />(e) Trustee may postpone sale of all or any portion of <br />said property by public announcement at such time and place of <br />sale, and from time to time thereafter may postpone such sale by <br />public announcement at the time and place fixed by the preceding <br />postponement; and, except as otherwise provided by any applicable <br />provision of law, the Trustee, without further notice or <br />publication, may make such sale at the time and place to which the <br />same shall be postponed. <br />-16- <br />In <br />MIN <br />
