106894 <br />rights in and to said real estate, and also to convey, <br />transfer, and assign all of their right of possession, <br />rental, and equity of redemption in and to said promises, <br />With full release of all their right, title, and interest of <br />every character in and to said property; that the value; of <br />said real estate is not in excess of the amount of said <br />indebtedness outstanding, and in consideration of such <br />conveyance, they have received a full and couplet* release of <br />personal liability on said promissory notes; and that <br />possession of said Promises has boon surrendered to the <br />grantee; <br />That they hereby, represent that they have not requested <br />any materials delivered or services rendered on the <br />above - described premises which would be the subject for a <br />Mechanic's Lien against said premises; <br />That affiants gave said Deed voluntarily and in good <br />faith, without any fraud, misrepresentations, duress, undue <br />influence, or misunderstanding , on their part or the part of <br />their Grantee, and said Do" was not given as a preference <br />against any of their other creditors; that at the time it was <br />given there was no other person or persons, firms or <br />corporations, other than the grantee therein named <br />interested, either directly or indirectly in said premises; <br />that the affiants have no other creditors whose rights would <br />be prejudiced by such conveyance, and that affiants are not <br />obligated upon any bond or other mortgage whereby any lien <br />has been created or exists against the premises described in <br />said deed; <br />That this Affidavit has been made for the protection and <br />benefit of its Grantee in said Deed, its successors and <br />assigns, and all other parties hereafter dealing with, or, <br />who may acquire an interest in the property described herein, <br />and shall bind the respective heirs, executors, <br />administrators, and assigns of the affiants. <br />That, Affiants will testify, declare, depose, or certify <br />before any competent tribunal, officer, or person, in any <br />case now pending or which may hereafter be instituted, to the <br />truth of the particular facts herein set forth. <br />J <br />(ELBE RT D.
