<br />each in his and her own right and as spouse of the other, of
<br />Grand Island, Nebraska, herein called the Grantors, in
<br />Consideration of One Hundred Fifty Seven and 28/100 Dollars.........

<br />receipt of which is hereby acknowledged, hereby grant and convey
<br />unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation, in Hall County, Nebraska, herein called
<br />the Grantee, a permanent and perpetual easement and right -of -way
<br />to construct, operate, maintain, extend, repair, replace, and
<br />remove public utilities, including but not limited to, sanitary
<br />sewers, storm drainage system, manholes, surface markers, and
<br />other appurtenances, upon, over, in, and through a tract of land
<br />located in Lot One (1), Ross Heights Seond Subdivision in the
<br />City of Grand Island, Nebraska, more particularly described as
<br />follows:
<br />The westerly eight (8) feet, except the southerly forty (40)
<br />feet of Lot One (1) of Ross Heights Second Subdivision, said
<br />tract containing 1,104 square feet (.025 acres), more or
<br />less, as shown on the plat marked Exhibit "A ", dated October
<br />22, 1984, attached hereto and incorporated herein by
<br />reference;
<br />together with the following rights, namely, unrestricted ingress
<br />and egress under, over, and across such land for the purpose of
<br />exercising the rights herein granted, to clear and keep clear of
<br />trees, roots, brush, and other obstructions from the surface of
