TRUSTEE'S DEED
<br />KNOW ALL MEN BY THESE PRESENTS: That JOSEPH 11. BADAMI, Trustee, upon
<br />a Deed of Trust made and entered into on or about June 27, 1983, by
<br />and between Michael J. Murphy and Janet L. Murphy, Trustors, and
<br />Joseph H. Badami, Trustee and First Federal Savings and Loan Association
<br />of Lincoln. Beneficiary, of the Mortgage Records of the Register of
<br />Deeds office of Hail County, Nebraska, herein called the GRANTOR, in
<br />consideration of Seventy -two Thousand and No /100 Dollars ($72,000.00),
<br />and other valuable consideration, received from Grantee, does hereby
<br />grant, bargain, sell, convey and confirm unto FIRST FEDERAL SAVINGS
<br />AND LOAN ASSOCIATION OF LINCOLN, a United States Corporation, herein
<br />called the GRANTEE, the following described real estate in Hall County,
<br />Nebraska:
<br />Lot Seventeen (17), Block Three (3), in Lake Davis
<br />Acres Subdivision, Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above- described premises together
<br />with all tenements, hereditaments and appurtenances thereto belonging
<br />unto the Grantee, and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with the Grantee and with the
<br />Grantee's successors and assigns:
<br />(1) That Michael J. Murphy and Janet L. Murphy, Trustors,
<br />failed to pay the Beneficiary payments which were contractually due,
<br />and the Grantor, at the request of the Beneficiary, elected to declare
<br />the entire unpaid principal balance, together with interest thereon,
<br />at once immediately due and payable;
<br />(2) That a Notice of Default was filed by Grantor on May
<br />9, 1986, in Document No. 86- 102329 of the Miscellaneous records in the
<br />Register of Deeds office of Hall County, Nebraska. A copy of the
<br />Notice of Default was served upon Michael J. Murphy, Janet L. Murphy,
<br />Home Federal Savings and Loan Association of Grand Island, and John
<br />Doe and Doe, his wife, by certified mail, postage prepaid on May
<br />19, 1986
<br />(3) That Trustors, Michael J. Murphy and Janet L. Murphy,
<br />failed to cure the default referenced in the Notice of Default within
<br />30 days after the service of the Notice of Default.
<br />(4) That a Notice of Trustee's Sale was filed and a copy of
<br />the Notice of Trustee's Sale was served upon Michael J. Murphy, Janet
<br />L. Murphy, and Home Federal Savings and Loan Association of Grand
<br />Island, by certified mail, postage prepaid on July 31, 1986.
<br />(5) Grantor published Notice of Trustee's Sale, to be held
<br />on Thursday, the 11th day of September, 1986, at 10 o'clock a.m., at
<br />the Court House, Hall County, Nebraska, which Notice was published in
<br />Grand Island Independent, Hall County,. Nebraska, once a week for five
<br />(5) consecutive weeks, commencing on July 26, 1986, and ending on
<br />August 23, 1986. The last publication of Notice was at least ten (10)
<br />days prior to the Trustee's Sale, and said sale was not later than
<br />thirty (30) days after the last publication of Notice.
<br />(6) Grantor conducted the sale of the real property at
<br />public auction and has accepted the bid of First Federal Savings and
<br />Loan Association of Lincoln in the sum of Seventy -two - housand and
<br />No /100 Dollars ($72,000.00), as the highest bid upon said real property.
<br />Grantor has complied with the requirements of the above - referenced
<br />Deed of Trust and the requirements of Nebraska Statutes, 576 -1001
<br />through S76- 101.8, 1965, in the exercise of the sale of the real property
<br />described herein at the Trustee's Sale held on September 11, 1986.
<br />This Deed shall operate to convey to the Grantee, without
<br />right of redemption, the Grantor's title and all right, title, interest
<br />and claim of the Trustors, and their successors in interest and r)f all
