Except as specifically modified by this Loan Modifica- <br />tion Agreement, all other terms and provisions of the Note dated <br />21 , 19_24, previously executed by the Borrowers shall <br />re''� main in full force and effect. <br />3. The Note dated November 21 1984, hereby modified is <br />presently secured by a Deed of Trust dated NoygWer �, 19�, <br />and recorded as Document No. 84- 006212 in the office of the <br />Register of Deeds of Hall County, Nebraska, in respect to that <br />real estate described as: <br />Part of Is3ts Fifteen (15) and Sixteen (16). in Block <br />Three (3) in Fifth Addition to the town of Cairo. Hall <br />CoLnty. Nebraska, described as beginning at a point 8() <br />fc)et east of the North%vest corner of Iot Sixteen (16) <br />in said Block Three (3) thence running Fast 60 feet <br />thence runnine-south 85 feet; thence <br />feet thence running north 85 feet to the place of -- <br />Lxminning <br />and, in accordance with the provisions of that Deed of Trust, it <br />shall remain as security for the indebtedness hereby modified. <br />4. All real estate mortgages, deeds of trust, assignments <br />and security agreements heretofore granted by Borrowers to the <br />Lender shall remain in full force and effect and shall in no <br />manner be affected by this Loan Modification Agreement and shall <br />continue as security for the indebtedness modified by this <br />Agreement, as well as any future indebtedness owing from Borrowers <br />to the Lender for future a'dlrances and renewals in respect to all <br />sums owing from Borrowers to the Lender. <br />5. Borrowers further covenant to and with the Lender that <br />they shall, and will, at any time, now or later, upon request, <br />make, do, execute and deliver all. such further and other acts, <br />deeds and things as shall be reasonably required to effectuate <br />the intention of this Loan Modification Agreement and to insure <br />and confirm to the Lender all and singular the property, securi- <br />ties and rights described, and intended to be conveyed as security, <br />so as to render the same, and all portions, whether now owned, or <br />later acquired, subject to these terms, provisions and conditions <br />according to the true intent and purposes expressed. <br />6. The failure of the Lender, at any time, to require the <br />performance by the Borrowers of any of these terms, covenants and <br />agreements shall, in no way, affect its rights to enforce the <br />same; nor the waiver by the Lender of any breach of any term, <br />covenant or agreement be taken or held to be a waiver of any <br />succeeding breach or any such term, covenant or agreement, or as <br />a waiver of the term, covenant and Agreement itself. <br />-2- <br />L L <br />U <br />W <br />
