<br />THIS AGREEMENT made and entered into this 5th day of
<br />June , 1986, by and between the following, to -spit:
<br />1. Norwest Bank Nebraska, N.A. ('Bank")
<br />2. Emil Schaaf and Beverly Schaaf, husband and
<br />Wife ( "Schaaf ")
<br />WHEREAS, Schaaf represents and warrants that they are -the
<br />owners of the following described real estate, to -wits
<br />The East Half of the Southeast Quarter WE SEk3.
<br />Lots One (1), Two (2) and Three (3) on Island,
<br />the Northeast Quarter of the Northwest Quarter
<br />(NE;NW;) , and pots Two (2.) and Three (3) Main-
<br />land, in Section Ten (10); the Southwest Quarter
<br />of the Southwest Quarter (SWkSWk) of Section
<br />Eleven (11); and the Northeast Quarter of the
<br />Northeast Quarter (NEENEk) of Section Fifteen
<br />r (15). all. in Township Ten (10) North, Range Tea
<br />(10), West of the 6th P.M., Hall County,,Nebraska,
<br />Lot Numbered Four (4) , Mainland, in the ?+Fortheast
<br />Quarter (NEA0 of Section Ten (30), Township Ten
<br />(10) North, Range Ten (10), test of the 6th P.M.,
<br />Hall County, Nebraska; and
<br />WHEREAS, Schaaf also represents and warrants that they have
<br />]eased said premises to the following named person,. to-wit:

<br />entitling Schaaf to receive rents or profits from the 198.6 crop
<br />wiaich per - consists of 45 bushel r acre rent for the landlord
<br />Schaaf; and
<br />WHEREAS, in consideration of the Bards renewing exist._ ng in-
<br />debtedness and making additional advances and loans to Schaaf which
<br />requires additional security therefor, Schaaf is willing to trans-
<br />fer and assign to Bank all of the rents and profits derived from
<br />the premises pursuant to said lease until Bank is paid in full.
<br />IT IS MUTUALLY AGREED AS FOLLOWS:
<br />I- Schaaf hereby sells, assigns and transfers to Bank, its
<br />successors and assigns, all the rents, issues, profits and income
<br />now due, or that subsequently arise, issue or become due from the
<br />premises, or from any part or part of the premises pursuant to the
<br />lease with Harlan Kenyon.
<br />2. That Schaaf irrevocably appoints the Bank, its susses- ,
<br />sots and assigns as Schaaf's true and lawful attorney or attorneys
<br />in its name, place and stead to demand, sue for, attach, levy, re
<br />cover and receive and to compromise and adjust and deliver receipts
<br />and releases for all rents, issues, income and profits that they
<br />may now be due or become due pursuant to the lease with Harlan Kenyon,
<br />to institute, compromise and settle all summary proceedings, ac-
<br />tions and suits for removing any and all leassees, tenants or oc-
<br />cupants of the premises, or of any part or parts of the premise --,.
<br />and /or to enforce or enjoin or restrain the violation of any of
<br />the terms, provisions or conditions of any lease or leases now or
<br />later affecting the premises; generally, to do, execute and per -
<br />form any other act, deed, matter.or thing, that ought to be done,
