<br />KNOW ALL MEN BY THESE PRESENTS, that Arthur W. Phillips and
<br />Joanne B. Phillips, husband and wife, ( "Grantors ") in con-
<br />sideration of Ten Dollars ($10.00) and other good and valuable
<br />considerations, in hand paid, do hereby grant, bargain, sell,
<br />convey and confirm unto JOHN DEERE COMPANY, a Delaware corpor-
<br />ation, having an office at 3210 East 85th Street, Kansas City,,
<br />Jackson County, Missouri 64132 ( "Grantee "), the following
<br />described real estate situate in the County of Hall, State of
<br />Nebraska, to -wit:
<br />Lot Twenty Three (23), in Brentwood Third Subdivision in
<br />the City of Grand Island, Nebraska
<br />Subject to covenants, restrictions, reservations and ease-
<br />ments now of record and subject to a mortgage in favor of
<br />Home Savings and Loan Association, County of 'Hall, State of
<br />Nebraska.
<br />together with all the tenements, hereditaments and appurtenances
<br />to the same belonging and all the estate, title, dower and right
<br />of homestead, claim or demand whatsoever of the Grantors, of, in
<br />or to the same or any part thereof.
<br />TO HAVE AND TO HOLD the above- described premises, with the
<br />appurtenances unto the said Grantee and to its successors and
<br />assigns, forever, and the said Grantors, for themselves. and for
<br />their heirs, executors and administrators, do covenant with the
<br />said grantee and with its successors and assigns, that they are .
<br />lawfully seized of said premises; that they are free from encum-
<br />brance, subject to any restrictive covenants and. easements of
<br />record, if any; that the Grantors have good right and lawful
<br />authority to sell the same, and that they will and their heirs,
<br />executors and administrators shall warrant and defend the same
<br />unto the said Grantee and its successors and assigns forever
<br />against,the lawful claims of all persons whomsoever, except as
<br />above- mentioned and except all taxes and assessments, general and
<br />special, for the year 1986 and all subsequent years exceptiny
<br />easements and restrictions of record, if any.
