The maintenance of the underground fuel tank shall be the responsibility of the Permittee. 2.� The Permittee shall be responsible for any loss,or damage caused by the Permitbe*�Is hment on the right of.way. The Permitteevill hold the State harmless. from encroac any Law Suits brought against the State or Permittee arising out of the Permitteets, -encroachment on the right of way. 3. The State reserves the right to construct, maintain, use,.operate, relocate, reconstruct and renew such highway facilities as it may at any time, and may from time to time, desire within t1w_ limits of said right of way, including the right to use said right of way for any and all purposes, and if such construction, maintenance, use, operation or relocation require the movement of Permittee's fuel tank, such movement shall be at the sole expense of Permittee, the,ir.heirs, or assigns.. 4. The Permittee shall at no time permit. construct, reconstruct or placeamy el, i] Itted additional structures, fac- Utles or other encroachments upon the perm area of State right of way without written consent of,the State Department of Roads, Director-State Engineer,and the- Permittee shall at no time alter or reconstruct thepresent encroachment, consisting of a underground fuel tank, without prior written approval of the State. 5. The permittee, by receiving thi permit, Lmderstands, acknowledges and agriies -it where the that upon 30 days written notice the, State can cancel this perm right of way is necessary for construction, reconstruction or maintenance of U.S. Highway No-30 and that the Pervittee will move the encroachment from the right of way within 60 days at-no cost or expense to the State and Pe3mdttee agrees that, if he fails to -remove the encroachment with 60 days the- State �blecomes sole and complete ovaer of the encroachment and may cause its removal or-destruction with no compensation due- the Permittee and at the sole cost of the Permittee, their heirs or assigns. (K..'The,Pervittee, understands and acbwvledges that violation of any of the.terms of these permit conditions shall cause automatic revocation of this permit and will cause the immediate removal of the permitted eucroacbment,by Permittee, or the State after 60 days'notice of the violation. 7. No other or additional uses of the right of way shall be permitted.
