<br />RELEASE OF EXPRESS RESTRICTIONS AND 'CONDITIONS
<br />WHEREAS, the undersigned Grantor, LUTHERAN HOSPITALS
<br />AND HOMES SOCIETY OF AMERICA, a non- profit corporation, with
<br />its principal office in.Fargo, North Dakota. (also known,
<br />and taking title to real estate, as Lutheran Hospitals and
<br />Homes Society of America, Inc., of Fargo, North Dakota, a`
<br />corporation "organized and existing under and by virtue of
<br />the laws of the ' +State ` of 'North Dakota), conveyed to the
<br />undersigned' Grantees, JAY- C. STODDARD and CLARENCE E.
<br />RITCHIE by Corporation Warranty Deed, the following-
<br />described real property`:
<br />Lots Four (4 <), Five (5), Six (6), Seven (7) and
<br />Eight (8) in Medical Park Third Subdivision to.the
<br />City of Grand Island,. Hall County, Nebraska, as
<br />surveyed, platted and recorded,
<br />such Corporation Warranty Deed being recorded as Document
<br />No. 78- 002157 in the Office of the Register of Deeds of Hall
<br />County, Nebraska, and
<br />WHEREAS, said Corporation Warranty Deed contains the
<br />following express restrictions and conditions:
<br />" 3. Grantees and their respective heirs, assigns
<br />and successors in interest are prohibited
<br />from selling any lot, lots or parts of lots
<br />for a consideration greater than the pro rata
<br />purchase price of each lot or fraction of a
<br />lot represented by the consideration shown in
<br />this Deed computed on a square- footage basis,
<br />plus Grantees' expense for development of the
<br />lots, excluding any expense incurred for
<br />contractica of buildings.
<br />4. The express restrictions and conditions in
<br />this Deed may be enforced by Grantor or by
<br />the owner or owners of any other lot or lots
<br />located in Medical Park Third Subdivision to
<br />the City of Grand Island, Hall County,
<br />Nebraska." and
<br />WHEREAS, the undersigned, Jay C. Stoddard and Clarence
<br />E. Ritchie, are the owners of all of the above - referred real
<br />property, and
<br />WHEREAS, the undersigned Grantor and Grantees now
<br />desire to rescind and release the aforesaid express
<br />restrictions and conditions,
<br />NOW, THEREFORE, BE IT AGREED BY AND BETWEEN THE
<br />PARTIES HERETO that the express restrictions and conditions
<br />set forth above are hereby mutually released and rescinded
<br />by the parties hereto, and of no further force and effect
<br />whatsoever.
