c <br />86-- 10,78 <br />E L E C T R I C A L E A S E M E N T <br />CHIEF INDUSTRIES, INC., a Delaware corporation, herein called Grantor, <br />in consideration of One Dollar ($1.00) , receipt of which is hereby <br />acknowledged, hereby grants and conveys unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation in Hall County, Nebraska, herein called Grantee, a <br />permanent and perpetual easement and right- of-way to survey, construct, <br />inspect, maintain, repair, replace, extend, remove, and operate thereon, <br />overhead electrical utility lines, poles, anchors, terminals, transformers, <br />surface markers, and other appurtenances connected therewith, in, upon, above, <br />along, across, underneath, and through a tract of land located in part of <br />Reuting's Second Subdivision, Grand Island, Hall County, Nebraska, being more <br />particularly described as follows: <br />The Northerly sixteen (16.0) feet of Lot Forty (40), <br />Reuting's Second Subdivision; <br />The Westerly six (6.0) feet of the Easterly twelve (12.0) <br />feet of Lot Forty (40), Lot Forty One (41), and Lot Forty Two <br />(42), Reuting's Second Subdivision; <br />The Northerly sixteen (16.0) feet of the Easterly sixty seven <br />(67.0) feet of Lot Forty Seven (47), Reuting's Second <br />Subdivision; and <br />The Southerly eight (8.0) feet of the Easterly sixty seven <br />(67.0) feet of Lot Forty Eight (48), Reuting's Second <br />Subdivision. <br />The above said tracts containing a total of 0.115 acres, more <br />or less, as shown on the plat dated 6/19/86, marked Exhibit <br />"A ", attached hereto, and incorporated herein by reference; <br />together with the following rights: <br />Unrestricted ingress and egress to the above described easement tract for <br />the installation, maintenance, operation, and removal of such overhead <br />electrical utilities and appurtenances. <br />Such rights of ingress and egress shall include all rights necessary for <br />the full and complete use, occupation, and enjoyment of the easement herein <br />granted, including the right to excavate and refill ditches and trenches; to <br />remove, clear, and keep clear trees, bushes, hedges, undergrowth, and other <br />obstructions interfering with the surveying, construction, inspection, <br />maintenance, repair, replacement, extension, removal, or operation of such <br />overhead electrical utilities and appurtenances. No structures, buildings, <br />fences, or other obstructions of any kind whatsoever, shall be allowed in, <br />upon, above, along, across, underneath, or through the easement herein <br />granted. <br />Grantor and Grantee hereto agree that the Grantor may continue to use the <br />easement herein granted for any use permitted by law, that does not interfere <br />with the operation and maintenance of the overhead electrical utilities and <br />appurtenances constructed therein. <br />
