"Lot 3" is the Air Space premises designated <br />as Lot 3 on Exhibit "A ", including the Improvements located <br />thereon <br />Section 2.8 "Lots" shall mean Lot 1, Lot 2 and Lot 3. <br />Section_ 2..9'. "Owner" shall mean and refer to any one or <br />more persons or entities including Landlord who is /are the record <br />owner(s) from time to time of fee simple title to any of Lots 1, <br />2 and 3 or a portion thereof or .interest therein, the vendee <br />under a land sale contract for any such interest, and a lessee of <br />any such interest for a term of ninety -nine (99) years or more. <br />"Owner" shall not mean or refer to the Tenants or any tenant, <br />lessee, subtenant or sublessee whose tenancy is for ninety -eight <br />(98) years or less or to any person or entity holding any such <br />interest merely as security for the performance of a monetary <br />obligation; provided, however, that upon foreclosure, trustee <br />sale or other similar transfer of the legal and /or beneficial <br />title to any such interest. the person or entities who receive <br />such title shall become "Owner(s)." <br />Section 2.10. "Party" shall mean the Landlord, Tenant of <br />Lot 1 or Tenant of Lot 2. "Parties" shall mean the Landlord, <br />Tenant of I.ot 1 and Tenant of Lot 2. <br />Section 2.11. "Plan" shall mean the official Redevelopment <br />Plan of the Central Business District, Grand Island, Nebraska <br />which was approved by the Grand island City Council in July 1984 <br />and amended in May 1985, copies of which are on file in the <br />office of the Grand Island City Clerk, together with any and all <br />WE <br />a <br />1W <br />J <br />
