<br />AMENDMENT TO DECLARATION
<br />OF
<br />THE IkANCEY, A CONDOMINIUM
<br />As of this let day of March, 1986, the Declaration of The Yancey, a
<br />Condominium ("Declaration ") dated October 16, 1984 and recorded as Instru-
<br />ment No. 84- 005507 in the Register of Deeds Office of Hall County, Nebraska
<br />for the following described real estate:
<br />Condominium Unit No. 001, 002, 101, 102, 103, 201, 301,
<br />302, 303, 304, 305, 401, 402, 403, 404, 405, 406, 407,
<br />501, 502, 503, 504, 505, 506, 507, 601, 602, 603, 604,
<br />605, 606, 607, 701, 702, 703, 704, 705, 706, 707,'801,
<br />802, 803, 804, 805, 806, 901, 902, 903, 904, 905, 906,
<br />1001, 1002, 1003, 1004, 1005, 1006, 1101, 1102, 1103,
<br />1104, 1105, 1106, The Yancey, a Condominium, a condo -
<br />minium in accordance with the Declaration recorded on
<br />October 17, 1984, under Document No. 84- 005507 of the
<br />County of Hall, State of Nebraska, records,
<br />is amended to reallocate certain Class "A"- Limited Property, Class "B"- Limited
<br />Property, Class "C" Property and to create Condominium Unit Nos. 001 and
<br />002, The Yancey, a Condominium, a condominium in accordance with the
<br />Declaration recorded on October 17, 1984, under Document No. 84- 005507 of
<br />the County of Hall, State of Nebraska, records as follows:
<br />1. Change in Text. The Declaration at page 11, Section 13, is hereby
<br />amended by amen ing the third full sentence therein to read as follows:
<br />"Assessments to a Unit and voting rights with respect to
<br />Class "C" Property were calculated by first allocating
<br />twenty -two percent (22 %) to Class "B" Units in general
<br />and seventy -eight percent (78 %) to Class "A" Units in
<br />general which division is approximately the area of each
<br />class of property in relation to the total area of the
<br />Project, and then determining each Unit's initial sale price
<br />as a percentage of the total initial sale prices of all the
<br />Units in the Project."
<br />2. Exhibit "B". Exhibit "B" to the Declaration is hereby amended by
<br />deleting page the 13 page Exhibit "B" and inserting in substitution
<br />therefore as page 1 that plan set out on Attachment "1 ", attached hereto and
<br />incorporated herein by this reference.
<br />3. Allocated Interests on General Issues. Exhibit "E" of the Declara-
<br />tion titled Schedule of Allocated Interests is hereby deleted and Attach-
<br />ment "2" of the same title, attached hereto and incorporated herein by this
<br />reference, is hereby substituted therefore.
<br />4. Class B Allocated Interest. Exhibit "G" of the Declaration titled
<br />Schedule of lass 1113" A located nterestsis hereby deleted and Attach-
<br />ment 11311 of the same title, attached hereto and incorporated herein by this
<br />reference, is hereby substituted therefore.
<br />5. These amendments were consented and agreed to in writing by all
<br />persons entitled to cast votes on behalf of the owners of Units in The
<br />Yancey, a Condominium as certified to on the attached Certificate and are
<br />hereby amended in accordance with the provisions of the Declaration and the
<br />Nebraska Uniform Condominium Act.
