86- 103071 <br />PUBLIC UTILITY EASEMENT <br />JAMES E. PRICE and DELO RIS M. RAUERT, each in his and her <br />own right, herein //called the Grantors, in consideration of <br />receipt of which is hereby acknowledged, hereby grant ant convey <br />unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation, in hall County, Nebraska, herein called <br />the Grantee, a permanent and perpetual easement and right -of -way <br />to construct, operate, maintain, extend, repair, replace, and <br />remove sanitary sewers, manholes, and other appurtenances, upon, <br />over, in, and through the easterly eight (8) feet excepting the <br />southerly eight (8) feet of Lot 24 of LeHeights Third Sub- <br />division, said tract coat- airing 1,296 square feet (0.030 acre), <br />more or less, as shown on the plat. dated 11/7/84, marked =xhibit <br />"A ", attached hereto and incorporated herein 'oy reference; <br />together with the following rights, namely, unrestricted ingress <br />and egress under, over, and across such land for the purpose )f <br />exercising the rights herein granted, to clear and keep clear of <br />trees, roots, brush_ and other obstructions from the surface of <br />such tract. Any such utilities and appurtenances placed .upon, <br />over, and under such tract of land shall remain the property of <br />the Grantee and may be removed or replaced at any time. <br />The Grantors, for themselves, their heirs, executors, <br />administrators, successors and assigns, hereby covenant that no <br />buildings, fences, or structures shall be erected or permitted on <br />said tract and that. the easement herein granted shall run with <br />U <br />J <br />I <br />
