86--• 102855 be applied against any then existing indebtedness owed by the Assignors to Assignee. In the event of default by Assignors, Assignors further constitute Assignee their true and lawful attorney for Assignors and in their names, but for the sole use and benefit of the Assignee and its assigns to collect, demand, sue for, in its own name and right, receive, compound, settle and compromise any sums owing by Lessee under such Lease Agreement to Assignors and apply the same to indebtedness owing to Assignee from Assignors. It is the intention and agreement of the Assignors that this Assignment shall also secure any future advances made to Assignors by Assignee and any and all indebtedness in addition to the amount stated above which said Assignors, or any of them, may owe to said Assignee, however evidenced, whether by note, book, account or otherwise. The undersigned also agrees that this Assignment shall secure all costs, charges and expenses reason- ably incurred or paid by Assignee, including reasonable attorney fees, because of the failure of the undersigned to comply with the terms of the Deed of Trust Note aforementioned, as extended and modified, or this Assignment. The failure of the Assignee to assert any of its rights hereunder at any time shall not be construed as a waiver of its right to assert the same at any later time, and to insist upon and enforce strict compliance with all the terms and provisions of said Deed of Trust Note, as extended and modified, and of this Assignment.
