<br />ASSIGNMENT
<br />KNOW ALL MEN BY THESE PRESENTS: That we, Leon 0. Selle and Beth D. C. Selle,
<br />Husband and Wife, each individually in his and her own right and as Husband and
<br />Wife, being the Purchasers in a certain contract of sale and agreement made and
<br />entered into on the 1st day of July,j 82, by us as Purchasers. A copy of the
<br />contract is attached hereto and made a part hereof. In consideration of that
<br />certain promissory note dated April 28, 1983, and due on April 28, 1988, in the
<br />principal amount of FIFTEEN THOUSAND SIR HUNDRED AND N01100 DOLLARS ($15,600.00),
<br />together with interest thereon at Fourteen and One -Half Per Cent (14'z %) per annum,
<br />from and after April 28, 1983, which note was made, executed and delivered by
<br />Leon 0. Selle and Beth D. C. Selle. The property agreed to be conveyed in such
<br />contract is hereby assigned, transferred and set over to The First National Bank
<br />of Grand Island, Grand Island, Nebraska, all of our right, title, and interest
<br />in and to such contract and agreement, together with any and all monies due or
<br />which may become due hereunder, tv have and i.o bold the .;ame to r e First
<br />National Bank of Grand Island, Grand Island, Nebraska, its successors and assigns
<br />forever, subject only to the conditions therein contained.
<br />This Assignment is given and made as collateral security for a certain
<br />promissory note given by us on this date to The First National Bank of Grand
<br />Island, Grand Island, Nebraska, in the principal amount of $1.5,600.00, payable
<br />on the 28th day of April, 1988, with interest at the rate of T14-!% p-er annum,
<br />payable semi - annually, such note being given and taken as hereinbefore described.
<br />We, the undersigned, each individually in his and her own right and as
<br />spouse of the other, specifically authorize The First National Bank of Grand
<br />Island, Grand Island, Nebraska, its successors or assigns, to receive and receipt
<br />for any and all sums due to us or to either if us from the sale of such contract,
<br />and to give a good and valid receipt therefor and we do further authorize The First
<br />National Bank of Grand Island, Grand Island, Nebraska, its successors or assigns,
<br />in case of default on the part of the purchaser under such contract and agreement,
<br />to bring in its own name, ,r in our name and as our attorney for that purpose,
<br />any and all actions or proceedings, either at law or in equity, for the recovery
<br />of any sums due under such contract or for the foreclosure thereof, and agree
<br />that in the event of suit thereon and foreclosure thereof, that the said The First
<br />National Bank of Grand Islana, Grand Island, Nebraska, uiay fiist, out of the proceeds
<br />of such action, reimburse itself for any costs and expenses incurred in such suit
<br />or foreclosure, pay any and all other or prior liens and encumbrances and reimburse
<br />itself for any and all sums due an owing on the promissory note hereinbefore
<br />described, together with interest thereon as therein provided, and thereafter
<br />to pay any balance remaining over and above such sums to the undersigned, or to
<br />such person or persons as may then be entitlted thereto.
