AFFIDAVIT ppc STATE OF NEBRASKA ) ss. Qp— 10199 COUNTY OF CUSTER ) Howard W. Spencer, of lawful age, being first duly sworn, deposes and says: that Affiant is an attorney at law with offices located at Broken Bow, Custer County, Nebraska. Affiant represented as attorney the administration proceedings in the Estate of Marguerite F. Lee, Deceased, which appears in Docket 39 at page L8 in the County Court of Hall County, Nebraska; that through inadvertence and error there were filed in the Office of the Hall County, Nebraska Register of Deeds two (2) erroneous Certificates of County Court Proceeding Involving Real Estate in connection with the administration of the aforementioned estate. The first erroneous Certificate was filed August 4, 1981, and recorded as No. 81- 003994; and the second erroneous Certificate was filed October 26, 1981, and recorded as No. 81- 005423. That Affiant knows of his own personal knowledge that the decedent, Marguerite F. Lee, did not at any time during her lifetime nor at the time of her death, own, possess or claim any interest whatsoever in the real estate described as: The Northeast Quarter of the Southeast Quarter (NE }SE}), and the + West Half of the Southeast Quarter (WJSE}) of Section Three (3), Township Twelve (12) North, Range Twelve (12), West of the 6th P.M., in Hall County, Nebraska. Affiant knows of his own personal knowledge that none of the heirs at law of said decedent own, possess or claim any interest whatsoever in the foregoing described real estate. Affiant further states that in determining liability of the Estate of Marguerite F. Lee, Deceased, for state and federal death taxes, only the real estate actually owned by the decedent was taken into consideration and not the above - described real estate.
