86-- 101845 <br />3.16. Default Rate of Interest. From and after the <br />payment of a o gations and liabilities under the Notes <br />and the Loan Agreement, the expressions used herein <br />referring to the after maturity rate of interest as provided <br />in the Notes shall be deemed to be in reference to the <br />"Default Rate" as set forth in the largest (in face amount, <br />from time to time) unpaid promissory note making up part of <br />the Guaranteed Obligations. <br />3.19. Successor Agent. From and after the payment of <br />all obligations and — liabilities owed to the Banks hereunder, <br />under the Notes, under the Loan Agreement and under the Bank <br />Guaranty, Surco shall automatically become the Agent for all <br />purposes going forward. All predecessor Agents shall <br />continue to benefit from the reimbursement and <br />indemnification provisions of this Mortgage. <br />3.20. Limitation on Amount of Liabilities Secured by <br />Kansas Properties. Notwithstanding anything contained in <br />this Mortgage to the contrary the Banks, Surco, and <br />Mortgagor agree as follows: counterparts of the Mortgage <br />recorded and filed in the counties of Kansas listed on <br />Schedule III attached hereto shall not secure payment of any <br />advances which the Banks or Surco may make to the Mortgagor <br />or obligations of the Mortgagor to the Banks or Surco <br />pursuant to the terms of the Loan Agreement, the Notes, the <br />Surco Note, the Bank Guaranty, the Surco Guaranty or the <br />r <br />Mortgage in excess of for each such county the principal <br />amount stated in said Schedule III, nor shall counterparts <br />of the Mortgage recorded and filed in such counties secure <br />payment of any other indebtedness of the Mortgagor which may <br />be owing to the Banks or Surco in excess of the <br />aforementioned principal amounts, notwithstanding the,a <br />provisions of the Mortgage, unless and until additional <br />collateral security documents are presented for recording in <br />Kansas and /or additional Kansas mortgage registration taxes <br />are paid. The Banks and Surco agree to release the Mortgage <br />upon receipt of prepayments in the amounts set forth on <br />Schedule III hereto. <br />-36- <br />
