'. <br />86- 101845 <br />First: To the payment and satistaccion of all <br />costs an- expenses incurred by the Trustees and the <br />Agent (acting in the agent capacity) in the performance <br />of their duties including, without limiting the <br />generality of the foregoing, costs and expenses of any <br />entry, or taking of possession, of any sale, or <br />as well, <br />advertisement thereof, and of conveyances, and <br />court costs, compensation of agents and employees and <br />legal fees. <br />Second: To the payment of the Liabilities, pro <br />rata according ing to each Lender's percentage of the <br />aggregate unpaid amount of the Liabilities outstanding <br />at the time of such payment or as otherwise established <br />in any intercreditor agreement established by and among <br />the Lenders. <br />Third: Any surplus thereafter remaining shall be <br />paid to the Mortgagor or the Mortgagor's successors or <br />assigns, as their interests shall appear. <br />2.13. The Mortgagor's Waiver of Appraisement, <br />Marshallinq and other Ri hts. The Mortgagor agrees, to the <br />u I extent that the Mortgagor may lawfully so agree, that <br />the Mortgagor will not at any time insist upon or plead or <br />in any manner whatever claim the benefit of any <br />appraisement, valuation, stay, extension or redemption law <br />A <br />now or hereafter in force, in order to prevent or hinder the <br />enforcement or foreclosure of this instrument or the <br />thereof by <br />absolute sale of the Collateral or the possession <br />an urchaser at an sale made pursuant to any provision <br />eof, or pursuant to the decree of any court of competent <br />hery <br />jurisdiction; but the Mortgagor, for the Mo igagor and all <br />who may claim through or under the Mortgago" so far as the <br />Mortgagor or those claiming through or under the Mortgagor <br />benefit of <br />now or hereafter lawfully may, hereby waives the <br />all who <br />all such laws.
