86 -. 101845 ' services for or in connection with any construction undertaken on, or services performed or to be performed in connection with, the Real Estate or the Improvements Gall of the foregoing are herein referred to collectively as the "Contracts for Construction "); (xi) Contracts for Sale or Financin . All rights of the Mortgagor as seller or 5rrower under any agreement, contract, understanding or arrangement pursuant to which the Mortgagor has, with the consent of the Agent, obtained the agreement of any person to pay or disburse any money for the Mortgagor's sale (or borrowing on the security) of the Collateral or any part thereof (all of the foregoing are herein referred to collectively as the "Contracts for Sale "); and (xii) Other Property. All other property or rights of the Mortgagor of any kind or character related to the Real Estate, the Leasehold Estate, the Vendee's Interest or the Improvements, and all proceeds (including, without limitation, insurance and condemnation proceeds) and products of any of the foregoing. (All of the Real Estate, the Leasehold Estate, the Vendee's Interest and the Improvements, and any other property which is real estate under applicable law, are sometimes referred to collectively herein as the "Premises ".) I. Release of Existing Mortgages. The Agent is the holder of that certain mortgage (the "Existing Bank Mortgage ") recorded as set forth in Schedule I attached hereto and Surco is the holder of that certain mortgage (the "Existing Surco Mortgage ") recorded as set forth on Schedule II attached hereto. The Mortgagor has requested that the Agent and Surco release the Existing Bank Mortgage and the Existing Surco Mortgage, and the granting of this Mortgage is part of the consideration for so releasing the Existing Bank Mortgage and the Existing Surco Mortgage. THIS MORTGAGE IS INTENDED TO ACT AS A RELEASE OF THE EXISTING BANK MORTGAGE AND THE EXISTING SURCO MORTGAGE, SURCO AND EACH OF THE BANKS HEREBY RELEASE, REMISE, AND QUITCLAIM UNTO THE MORTGAGOR ALL RIGHT, TITLE, AND INTEREST WHICH ANY OF THEM HAS ACQUIRED IN THE PREMISES BY, THROUGH, AND UNDER THE EXISTING BANK MORTGAGE AND THE EXISTING SURCO MORTGAGE. Record title to the Fee Lands, the Leasehold Estates, and the Vendee's Interests is variously held by Pester Derby Oil Company; Pester - Schaefer Oil Company; Pesters, Inc.; Pester Colorado Corporation; and Hurco, Inc; and the Mortgagor.
