86 -. 101845 <br />' services for or in connection with any construction <br />undertaken on, or services performed or to be performed <br />in connection with, the Real Estate or the Improvements <br />Gall of the foregoing are herein referred to <br />collectively as the "Contracts for Construction "); <br />(xi) Contracts for Sale or Financin . All <br />rights of the Mortgagor as seller or 5rrower under any <br />agreement, contract, understanding or arrangement <br />pursuant to which the Mortgagor has, with the consent <br />of the Agent, obtained the agreement of any person to <br />pay or disburse any money for the Mortgagor's sale (or <br />borrowing on the security) of the Collateral or any <br />part thereof (all of the foregoing are herein referred <br />to collectively as the "Contracts for Sale "); and <br />(xii) Other Property. All other property or <br />rights of the Mortgagor of any kind or character <br />related to the Real Estate, the Leasehold Estate, the <br />Vendee's Interest or the Improvements, and all proceeds <br />(including, without limitation, insurance and <br />condemnation proceeds) and products of any of the <br />foregoing. (All of the Real Estate, the Leasehold <br />Estate, the Vendee's Interest and the Improvements, and <br />any other property which is real estate under <br />applicable law, are sometimes referred to collectively <br />herein as the "Premises ".) <br />I. Release of Existing Mortgages. The Agent is the <br />holder of that certain mortgage (the "Existing Bank <br />Mortgage ") recorded as set forth in Schedule I attached <br />hereto and Surco is the holder of that certain mortgage (the <br />"Existing Surco Mortgage ") recorded as set forth on Schedule <br />II attached hereto. The Mortgagor has requested that the <br />Agent and Surco release the Existing Bank Mortgage and the <br />Existing Surco Mortgage, and the granting of this Mortgage <br />is part of the consideration for so releasing the Existing <br />Bank Mortgage and the Existing Surco Mortgage. THIS <br />MORTGAGE IS INTENDED TO ACT AS A RELEASE OF THE EXISTING <br />BANK MORTGAGE AND THE EXISTING SURCO MORTGAGE, SURCO AND <br />EACH OF THE BANKS HEREBY RELEASE, REMISE, AND QUITCLAIM UNTO <br />THE MORTGAGOR ALL RIGHT, TITLE, AND INTEREST WHICH ANY OF <br />THEM HAS ACQUIRED IN THE PREMISES BY, THROUGH, AND UNDER THE <br />EXISTING BANK MORTGAGE AND THE EXISTING SURCO MORTGAGE. <br />J. Record Title Holders. Record title to the Fee Lands, <br />the Leasehold Estates, and the Vendee's Interests is <br />variously held by Pester Derby Oil Company; Pester - Schaefer <br />Oil Company; Pesters, Inc.; Pester Colorado Corporation; and <br />Hurco, Inc; and the Mortgagor.
