86-101474 <br />ACKNOWLEDGEMENT <br />The undersigned, PAUL L. OBERMILLER and BETTY LOU <br />OBERMILLER, husband and wife, identified as "Trustor" under a <br />certain Deed of Trust dated 19,&, to be entered <br />into among Trustor, Arend R. Baack, Attorney at Law, "Trustee", <br />and National Bank of Commerce Trust and Savings Association, <br />"Beneficiary", hereby acknowledge that this Acknowledgement is <br />made prior to their execution of that Deed of Trust in respect to <br />that real estate described as: <br />The Southwest Quarter (SWO of Section Ten <br />(10) , Township Twelve (12) North, Range Ten <br />(10) West of the Sixth (6th) Principal <br />Meridian, Hall County, Nebraska, excepting a <br />certain tract of land deeded to 4-M Agricultural <br />Associates, Inc. by Personal Representative's <br />Deed recorded as Document No. 79-001054; <br />and that they know and understand that (a) the Deed of Trust to <br />be executed by Trustor is a Trust Deed and not a Mortgage and (b) <br />that the power of sale provided for in the Deed of Trust provides <br />essentially different rights and obligations to the Trustor than <br />a Mortgage in the event of default or breach of obligation. <br />IN WITNESS WHEREOF, the undersigned have executed this <br />Acknowledgement on this day of 1986. <br />Paul L.
