F <br />Ai <br />gib_ 1 01304 <br />AFFIDAVIT <br />STATE OF NEBRASKA ) <br />(ss: <br />COUNTY OF HALL ) <br />Lamar Lepin, being first duly sworn upon oath deposes <br />and says: <br />1. He is well acquainted with and personally knows of <br />the ownership and the use and all agreements with respect <br />thereto of all tracts of real estate lying within the West <br />Half (W�) of Section Twenty -four (24), Township Nine (9) <br />North, Range Ten (10) West of the 6th P.M. in Hall County, <br />Nebraska. <br />2. He knows the contents of the Option to Purchase <br />real estate, Notice of which Option is filed of record as <br />Document No. 84- 003097 in the office of the Register of <br />Deeds of Hall County, Nebraska, and that it is the same <br />Option referred to in the letter of Bob Samuelson in the <br />letter which is recorded in the same office as Document No. <br />85- 003849 and that Bob Samuelson and Robert J. Samuelson are <br />one and the same persons notwithstanding the discrepancy in <br />names. <br />3. The said Option agreement has now expired and it <br />was not exercised by Robert J. Samuelson. <br />4. None of the driveway, property line or sewage <br />system agreements referred to in the Samuelson letter <br />(Document No. 85- 003849) or the Option affect in any way or <br />relate in any way to the Southwest Quarter (SW -) of said <br />Section. Neither Robert J. Samuelson nor anyone claiming <br />through him makes any claim of right or title or any other <br />agreement against the Southwest Quarter (SW;) of Section <br />Twenty -four (24), Township Nine (9) North, Range Ten (10) <br />West of the 6th P.M. in Hall County, Nebraska. <br />5.
