R6,. 101182 <br />(4) If Dr. Gregg Peterson does not agree to purchase that <br />part or all of the above described premises being sold, within <br />the thirty (30) day period, then the property may be sold free <br />and clear of.this first right of refusal. <br />(5) If Dr. Gregg Peterson does agree to purchase that part <br />or all of the above described premises being sold, then he shall <br />have thirty days from the day Carl R. Amick and Renee J. Amick <br />provide evidence of good and marketable title to Dr. Gregg <br />Peterson to close the purchase. <br />(6) If Dr. Gregg Peterson shall fail to satisfy his agree- <br />ment to purchase, then only that part of the property being <br />purchased by Dr. Gregg Peterson shall be sold free and clear of <br />this first right of refusal. <br />(7) Upon the provision of a good and marketable title by <br />general warranty deed signed by Carl R. Amick and Renee J. Amick <br />and following the satisfaction of any purchase agreement of Dr. <br />Gregg Peterson only the property transferred to Dr. Gregg Peterson <br />shall be free and clear of this first right of refusal. <br />(8) If there is a defect in obtaining marketable title, then <br />Carl R. Amick and Renee J. Amick shall have twenty (20) days to <br />correct said defect in order to provide marketable title in addition <br />to the time limits set out herein. If title is not then market- <br />able then Dr. Gregg Peterson shall have the option of either <br />completing the purchase or rejecting said purchase and if he does <br />so reject the purchase the property being sold shall be free and <br />clear of this first right of refusal but no other property shall <br />be free and clear of the first right of refusal. <br />(9) The consideration for this first right of refusal shall <br />be Ten Dollars ($10.00) receipt of which is hereby acknowledged. <br />(10) The first right of refusal shall run with the land and <br />shall be perpetual. <br />(11) If Dr. Gregg Peterson, D.D.S. exercises his first right <br />of refusal on the total parcel of land described herein in the <br />first paragraph herein, subparagraph (a), all in Section Two <br />Township Nine North, Range Ten West of the 6th P.M. in Hall <br />County, Nebraska, then he shall also have to purchase Lots 13 <br />and 14 of Amick Acres, Third Subdivision at the same per acre <br />cost on the same terms as the purchase of the other parcel. <br />-3- <br />
